My name has been removed from the IBIS

Timeline

Hi everyone,

Yesterday my name was offically removed from the IBIS for a 12 year old arrest warrant. The charge was dropped. On the advice from my congressman's office I sent the release letter from the county and a letter explaining the whole affair to their office. The congressional office also sent a letter to expedite things and back up my case. (as they said). So the ball is the court of ICE and the Nebraska USCIS. They seem very confident that I should have swift action now. Considering I have been waiting since Nov of last year. Again thanks to everyone who has looked after me. I am eternally grateful. Maybe I will not be a Nebraska"Prisoner" anymore. :dance::dance::dance:

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

June 01 2009 - NOA

July 13 2009 - Biometric

Oct 22 2009 - E-mail - card ordered

Oct 23 2009 - Received letter - approval date 10/19.

Thats a relief. You may explain your fiance that at the time of interview, she should be awared of any questions related to your previous police records.

Direct meeting & marriage: Dec 2003 USA, NY

I-130 petition in DCFR Tokyo: March 14th 2004. Case reffered to DHS USCIS

Four visits to japan in 2004: Oct 2004, wife got pragnant.

Wife/Fiance left USA and moved into Japan: Feb 5th 2005.

Baby Born: June 24th 2005(Japan)

I-130 denied: July 17 2005(Divorce was declared not valid)

Refiling Divorce: oJuly 17th 2005 NY State.

Divorce granted: Nov 17th 2005

K-1 application: Mar 1st 2006

Approval: May 23rd 2006

US consulate RFE: June 15th 2006

FRE sent (Original passports, birth certificate, all origional docs): July 10th 2006

Medical: Oct 11th 2006.

Interview: Nov 10th 2006(expected)

She is aware of this. However, there is no record because the charge was dropped. As it was explained there nothing to explain other than saying I was innocent and it was proven. So all we can say is it was a terrible mistake. So we move on and begin our life together.

I don't know what IBIS is even after 12 years many people are saying great for getting it cleared. I have seen others chastise anyone with a DUI and have to report it with an IMBRA rule? Why are we congratulating this offense which I clearly don't understand???? Yet DUI's dating back 20 years well as long as you have driven are now a peice of evidence? Could someone claim IBIS? Yes, I still don't know what IBIS is but I guess I'm willing to take a chance :D Can someone make a DUI from 1982 sound as cute as an IBIS??? God I hope that IBIS does not stand for I, Beat, The, Sh*T!!!$ out of ??? . I would much rather take the DUI, Do the people voting think the same?????

IBIS is Interagency Background Investigation Service. It is use by Immigration and Customs Enforcement (ICE), Border Patrol and other law enforcement agency for wants, warrants and lookouts. This is the primary means they use when they run a person name in the beginning. This is the dreaded "Name Hit"

Actually I was not approved....yet. But the biggest thing that prevented it is now not in our way. I got a good feeling that thing will get approved in the coming days or weeks. After 302 days I can be patient. I don't know how many of us are still left from 2005. Maybe a hand full. I was also told through the liason for the congressman that they will not move my case to California. Will see if this is true. One more thing when I get the approval you will hear me yell all the way to New York ( I'm in Chicago) Thanks for the pre-approval

oops....That will teach me to read with my eyes half closed. Thats twice I've done something similar in past couple of days. What a huge weight off though Scott, knowing you are clear of the checks. You're right, the approval shouldn't be too long in coming now. I don't think there is too many at all left from 2005.
