Im from Guatemala, I came with a B/1 visa, we got married december 2007, I didn't know how things had to work with my process but it is something that he is not taking seriously, I knew that USCIS gave some benefits to my country last year including speeding processes, I don't know what i can do, i don't know if we can still file my paperwork by ourselves, cause he always comes with the fact that is too much money for a lawyer but at the same time i don't know if i need one for all the time we have together and he never did petitions for me, I am confused cause i think that maybe not doing my paperwork before can damage a process right now. Please some advices???????

I am sure someone will help here but you have overstayed a long time hey so you are lucky you have not been picked up by immigration. If I am correct and I am sure others will correct me , you need to stay put file 130, and I-485 for GC. You will have to prove that when you came on B2 visa you did not have intent of immigrating that your wedding was not planned. You may need a lawyer down the track but there are many helpful people here who will advise you.

seems to me that your husband doesn't really care about you. A caring husband would make sure that his wife is safe in his country, and not be subject to detention or deportation.

You need to file forms I-130, I-485, I-765, I-864, and 2 x G-325a concurrently, at the same time, to adjust your status to that of a lawful permanent resident. The cost is close to $1,500 for everything, including a mandatory medical from a civil surgeon. Do not procrastinate. This is really important!

Per usual, Bob's got it right. You shouldn't need a lawyer, though. AOS from a tourist visa is pretty straightforward, unless there's something else you didn't mention that would cause problems.

10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.

Like Bob posted - very strange that a husband would put his wife at risk for deportation and a ban from the US when he can help her be in the US legally. In addition, it is illegal for the overstaying spouse to work and can result in severe penalties - and complete economic dependance on the legal spouse. Sounds like there is some control issues at work.
