Hello,

I just received notice that our I-130 was approved. I'm starting to research the steps at the NVC and I have a question!!

I've been living in Costa Rica for the past 16 months. I will start a job in the US at the end of July, but when I send in my I-864, employer letter etc. I won't be able to send in '6 months of pay stubs,' which seems to be the accepted norm.

We don't even have a case number at the NVC yet, but I'm worried that once it comes time, I won't have nearly enough pay stubs to show stable employement?

Anyone have any experience with this? Do they care if I can only give, for example, 2 weeks of pay stubs?

Not much different than a recent college grad starting her first job--you work with the evidence you have, and you will need a strong letter from your employer

Tax returns are mandatory unless you can show that you were not required file, like being below the filing threshold. Other evidence is optional, but oftentimes very helpful in making your case.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

That would delay your ability to schedule an internview though, correct?

It would delay my ability to interview, and seems like a silly reason to be apart for X months longer than we already have to.

I imagine that if they're not happy, they will just pull a 'request for more evidence'... hopefully by that point I will have enough 'evidence' to give them!

Even if they reject us for this, I believe it just means we have to start over at NVC (i.e. not start over at square one, USCIS).

I started my employment on 6/27 and my NOA2 is 6/21. I moved from the address I gave in I-130 to new address and am waiting for NVC case number, to talk to NVC and let them know of the change in address.

I am planning to send just one pay stub with a letter of my employment (the pay stub proves that I am working where I got your employment). My case a little different because, I was a student for the last 2 years and worked last summer and worked before the 2 years period, so I have tax returns (IRS transcripts) for the last 3 years. But my 2010 salary will not cover 125% of poverty line for 2, so I am getting my father to file I-864 (as we now live in two different cities). I am sharing, so that I may be missing something, which others can point out to me.

Bottom line - you ill at least need one pay stub, a well drafted letter expaling your circumstances, letter of employment with start date (this will let NVC know how many pay stub copies to expect). All the best. Please keep me in the loop, so that we knoe what is going on.

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)

10/30/11 - POE - Houston, TX

10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Congratulations! I am in a very similar situation. NOA2 date June 23, 2011 and am moving to start a new job August 1, after having been out of the country for several years.

Actually, the paycheck stubs are not required. I am still waiting to receive my NVC case number, so you should remember I haven't successfully navigated through the NVC (yet). A letter from your employer saying that you have a job, how much you make, and that you are in "good standing" or something saying that they don't expect to fire you, is enough. I will submit 3 years of tax returns (you can file them now if you didn't while you were out of the country) and also a bank statement about how much money I have saved.

Notice that in your income for this year, you should only put how much money you will make from your new job between July and December. So, if you don't clear the minimum requirement on that, you will have to look for other sources.

Finally, you can always use someone else to be a co-sponser. It can't hurt.

Thanks. One quick clarification - the annual pay needs to be the taotal annual pay and not just what we actaul will earn in 2011 (you never know your actual pay till 12/31/2011). That is the advise I got from others who filed their AOS. I will get another pay stub by 15th and an official emplyment letter in a day or two, so I won't bother about a co-sponsor.
