I got an RFE .. just now in the mail, I knew it was coming but I thought it would be for something else.

They are asking for me to have a medical done by a civil surgeon ...

I dont understand .. my medical was done Oct. 2010 .. we filed my AOS April 2011 ... how does my medical from Canada not meet this requirement ??

Is this common, because what I read said while filing out the forms said the form didnt need to be filled out - except the top portion - if a medical had been done within the last year.

March 2010 - sent off I-129F

March 27 2010 - Vermont receives package :)

April 3 2010 - Informed through mail that cheque is cashed NOA1

May 28 2010 - RFE notification ( yeah Im online checking alot >.< )

June 5 2010 - RFE hardcopy received

June 18 2010 - RFE returned ( had done it June 7 - but USPS returned grrrr )

--- case says we should hear from them in 60 days from June 18 ---

June 23 - Touched

Aug4 - Email notification of NoA2 :)

Aug. 10 - NOA2 Hardcopy received

Sept. 13 - Faxed off Package 3

Sept 14 - Interview notification set for Oct. 5

What about vaccinations?

If you did not record vaccinations during initial medical in Canada, you need to complete vaccination portion of I693 with Civil surgeon before filing for AOS

What exactly does your RFE say? Sometimes medicals get lost so they ask for a new one. Maybe that's the case with yours. Or like san diego said, it might be the vaccinations part.

I sent a copy of my vacinations from birth -> as current as possible. The Hep A&B was a 6 month course that I started when the initial k1 was sent in. I couldnt be more current if I tried. I also sent in the record of my flu shot.

I phoned USCIS and spoke with a couple people - they are having computer problems right now - the lady I spoke with said unless the doctor put the wrong date on it there was nothing wrong with the petition in this regard.

She said just to send in an explanation letter .. so Ill try that and see where we go from here.

The RFE says ... However the civil surgeon certified the exam more than one year before the applicant filed I485

Impossible ... logically speaking .. look at my timeline .. USCIS can verify that .. and the doctors, well they dont give you an exam without an invitation letter, USCIS can verify that, they can see the date the K1 was approved, which has to have a medical done, USCIS can verify that .. the timeline doesnt fit there reasoning at all. My pkg 4 and my interview were within about 3 weeks of each other, cant get medical appointment without that letter ...

If they lost the medical, why should that be on me ? And you say this happens alot ???

Ugh sorry to hear you got an RFE for this.. I wish they could just be clear about what they want, they seem to be really inconsistent with this. Hope you get it sorted out!

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

I received my K1 VISA in 6 months (June-December 2010)

I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Lee Summit, MO.. Usually the RFE has a return envelope that has the address on where to send it.. :) Mine was issued in CSC, so I sent mine there..

Are you saying you sent ONLY page 1 of the I-693??

You cannot send in a basically blank I-693 with only the personal part 1 info filled out. If you send in the I-693, you need to see a CS and have them fill in part 2, vaccinations section, and part 5, where they sign off on it.

Right after you posted about sending in your AOS paperwork, Vanessa&Tony mentioned to you this could happen, and had happened to someone recently who sent in the I-693 with only part 1 filled in, here in this thread: http://www.visajourney.com/forums/topic/312460-i-need-help-confused/page__p__4695279#entry4695279

Having sent the I-693 with only part 1 is what confused them, and made them ask for a whole new medical.

Ok, so yeah, .. I only filled out the part 1 - my personal information. I sent my entire vaccination history since birth and my winter flu shot records.

It says on the paperwork, that if youve had a medical done within the last year, that the rest didnt need to be filled in because it was done elsewhere . . .

When required, submit a medical exam report on Form I693, report of medical exam and vaccination record.

Fiances

If your a K1 who had a medical exam with the past year for non immigrant fiance visa, you need only to submit a vaccination suppliment, not the entire medical report.

So what exactly did I do wrong ?

Oh, and the RFE doesnt say anything about what your saying ... all it says on the RfE ... word for word is

You submited Form I693, Medical Examination and Vaccination Record. However, the civil surgeon certified the exam more than one year before the date the applicant filed the Form I485. For Form I693 must be dated within one year of filing form I485.

In order to process your application further, you need to submit a properly completed and signed form I693, report of medical examination and Vaccination Record for the applicant on form I485. The medical exnmination must be conducted by a civil surgeon who has been designated by USCIS.

My arguement here is that I had my medical October 2010.

From I-693 Instructions:

2. What if I am a K nonimmigrant visa holder and already had a medical exam overseas?

If you were admitted as a:

A. K-1 fiancé(e) or a K-2 child of a K-1 fiancé(e); or

B. as a K-3 spouse of a U.S. citizen or a K-4 child of a K-3 spouse of a U.S. citizen; and

C. You received a medical examination prior to admission, then:

a. You are not required to have another medical examination as long as your Form I-485, Application to Register Permanent Residence or Adjust Status, is filed within one year of your overseas medical examination, and the medical examination did not reveal a Class A medical condition, or if you did have a Class A medical condition, you received a waiver of inadmissibility and have complied with the terms and conditions on the waiver.

b. Even if a new medical examination is not required, you still must show proof that you complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the original, overseas medical examination report, you will have to have the vaccination report completed by a designated civil surgeon. In this case, you are required to submit Part 1, Information About You, Part 2, the vaccination chart and Part 5, the Civil Surgeon's Certification, of Form I-693.

You needed to have a CS transcribe your vaccinations on part 2 of the I-693, fill out and sign off on it in part 5. The CS would then seal it in an envelope to include with your AOS.

I am not sure if it would work now to go and have a CS transcribe them and have the I-693 filled out properly to send back for the RFE. Maybe along with a statement about having the medical in Canada less than a year ago? Could be worth a shot I suppose. I really do not know.

So what exactly did I do wrong ?

The vaccination supplement is when the CS completes the vaccination table in the I-693 and signs the form. They think you forgot the rest of the form :S

If your medical is still valid, and your shots are up to date you don't have to send anything. You CAN send a copy of your DS-3025 (and I did and would recommend it) to remind them your medical info is in there. This is what you SHOULD have done... now your have to fix it. Your best bet would be to see a CS and ask them for a vaccination transcription, AND include a copy of your DS-3025 as well as the I-693 instruction page that says K1's with a valid medical don't need a new one... and hope for the best.

It does NOT mention completing only part 1.. that's completely pointless :S
