Hi,

So we have already managed to resubmit our AOS package to correct our fees. Tracked the packaged and it successfully arrived at Chicago Lockbox. Yesterday, I can't explain why I'm shivering, I know there's something wrong. I got trouble with my printer and while attempting to fix it, I have just discovered that the Marriage License and NOA2 for I-129F was left inside the scanner. Grrrrrr... this is Crazy! What should I do now? Should I wait for another RFE from USCIS after a month? Is there a limit to the number of RFEs during AOS application?

Please let me know. things are going so stressful and crazy with this AOS.

I would just have copies of them ready to go, so when you get the RFE requesting them, you can send it back right away.

One of two things will happen. Either they will reject your application and send the whole thing back to you, or they will accept it and later notice the missing documents.

In the first case, just put the missing documents into the package and mail it right back to them.

In the second case, just wait until they send you an RFE, and then send them the missing documents.

Generally, you should not try to send the documents before you receive something back from USCIS. While they can, sometimes, successfully connect unsolicited documents back up to your existing file, it is much easier and more reliable, because of the way their internal processes work, to just wait until they send you an RFE or rejected packet, and then just respond appropriately.

Either way, this is really not anything to be massively worried or stressed about. The worst case scenario is that it will delay your approval and GC a week or two. The rejection and RFE processes are well defined and easy to follow, and as long as your case is on a well defined and easy to follow track, everything is fine, even if you know already that you will get an RFE.

And no, there is no limit to the number of RFEs that can occur during an AOS application - you have no need to worry about them saying anything like "Well, this is the third RFE we've had to send - three strikes, so we'll just deny it out of hand." It doesn't work that way. :)

Don't panic. Everything is still fine. Just keep those documents handy so you can quickly send them out when you get something from USCIS.

Super Thanks HeatDeath! You're response made me feel better and just let things go for the Will of God, just wait for it patiently. It's a relief to know that there's nothing that I should worry about and there's greater chance that we'll still have AOS application going. Thanks alot. God bless. :)

Yes, just wait for the RFE. Everything will be fine. At least you'll know they've looked at your case when you receive it. smile.gif

Thanks for your response. With my previous submission that I get RFE, I am just wondering why I don't get the email or text notification about it even if I have submitted the said Paper Reduction Form. It took them a month before they've sent the RFE to us. How soon should we contact USCIS to follow up our application?

I know in our state that the marriage license is what gives you permission to marry and you need to send in the marriage certificate from the county courthouse after your marriage is registered. Just sending in a license is not proof of marriage just that you paid the fee and can get married. Make sure that you send in the proper document.

Make sure you keep the original marriage certificate and take that and a certified copy to the interview. I know I sent in a certified copy with my AOS application, but at the interview she looked at the original and kept the copy. So maybe it got lost or who knows. So wait to see what they do--either reject the package or an RFE or schedule your biometrics appointment. It just may take a bit more time, but soon the process will be over and you can have 2 years minus 89 days without having to deal with the USCIS. Believe me it is well worth the wait.
