Well, our petition has been approved and is currently being processed in Vermont before it will be sent to the u.s. embassy in bogota. Please bear me as I have many questions that I have searched for and come up empty or with conflicting answers. These questions are for people who have specifically dealt with the u.s. embassy in Colombia. If anyone can help me, I would greatly appreciate it.

1. my hope is that the materials will be sent to bogota sometime this month, or by early October. Instead of waiting until she receives the packet and then obtaining the needed items (employer letter, bank letter, having the I-134 notorized), I would like her to have those in hand when she receives the packet. But will it be an issue with the embassy if these things are dated about a month before her packet arrives?

2. speaking of the packet that will be sent to her, will it be in English or Spanish?

As for the 1-134 itself, I know I am probably reading too much into it, but I am really paranoid about some kind of mistake on it and having the process delayed, so I have many (probably really stupid) questions about that.

I have seen where people have said that if you make sufficiently over the poverty guidelines, you do not need to fill in the rest of the blanks in question 7. Do you just leave them blank? Has anyone just left them blank and not had a problem? If these fields do need to be filled in, what is the best way to respond to the following:

Personal property: I guess I could look up the blue book value of the bobmobile and subtract what I owe on it. (I think the net would be about zero!). I have no idea what else to include or how to calculate the value.

Stocks and bonds: I don’t play the stock market, but I have about 4 different pension/retirement/401k/403b plans from current and previous jobs that either I would take a hit on if I took money out, or could not take money out even if I wanted to. it seems to me that these should not be included. or is the idea that if you die, these are benefits that would go to help support her?

Question 8: I have no former wife or children. The answer to this is none, correct?

Question 10: I put my fiancee’s name in here, correct?

Since she has an 11 year old son, and he is listed in the child field in question 3, do I need to have 2 separate I-134’s filled out (one for her and one for him) and have each one notorized ? This seems nonsensical to me since he is already listed on hers, but if I am reading it correctly I have seen this posted on the web. If so, does that change the responses to questions 3, 8, 9, 10?

Thanks a lot, bob

I only offer advice - not even legal. Just the plain and simple kind.

bob,

Recognize that the financial requirement for getting a K nonimmigrant visa is that the visa applicant demonstrate that they will not become a public charge after entering the USA. There are many ways to accomplish this, by far the way most often used is to have a US sponsor, typically (not not necessarily) the fiance(e) or spouse. The sponsor must show that they have sufficient financial resources to support themself, any other dependents, and the visa applicant.

Now, given that requirement, if one wants to go to the effort of documenting things that do not accomplish the purpose such as a bank account with negligible money in it, a car with no value when one owns only 1 car and except in some big cities there's no way to live in the USA without a car, or a house that's fully mortgaged when one needs a place to live and a cardboard box in the alley is generally considered to be socially unacceptable - then go ahead and spend the effort to identify and document things that are going to serve no useful purpose.

Myself, I had an income that I felt certain would be adequate to convince a reasonable consular officer that I could support my wife and keep her off the public dole, so I did not identify any of my assets. The consular officer apparently agreed with me, because the visa was issued with not inquiries as to why I did not show any assets.

On the other hand, if a person has marginal income then it would be prudent to scrape together as many things of value as possible in order to show that additional cash could be obtained by their sale if necessary.

Some consulates may ask for a separate I-134 for each person, others may ask for only one I-134 containing all of the names.
