Pull your I-864 by calling / mailing / faxing your request to cancel it. That you no longer wish to sponsor him. Report him to ICE if he is using you for a green card.

I echo this - write a letter withdrawing the I-864, Affadavit of Support.

Send it to:

1. USCIS, address on the I-797-C, receipt notice, for the I-485 packet.

2. Local USCIS Office

3. National ICE Office

4. Local ICE Office

I know it seems like it's a 'shotgun effect' but ya can't really know exactly where the casefile IS, today - and you need to get the withdrawal in front of the office that has the casefile, as well to the ICE offices.

now, if you want to build a case against him, of evidence to turn OVER to ICE, with the hope that ICE will take the evidence and build a case against HIM to DEPORT him for MARRIAGE FRAUD - that's possible also, but you have to supply evidence (repeat for emphasis EVIDENCE) to ICE and ask that a casefile for Immigration Visa Fraud be opened against him. It's not automatic, it takes time to do this, expect to go in for an Interview with local ICE officers.

But for now, these next 24 hours - get the letters written and out the door to withdraw the I-864, Affadavit of Support. This, in itself, will stop further I-485 processing, and without an I-864? He can't adjust status or be issued a green card.

You'll have something else to do, as well, for filing a divorce or annulment - dig into the county clerk's office nearby and learn what they want for filing a petition of divorce.

As others have said the petition is his, the affidavit of support is yours. You can pull the affidavit of support. Were you a K1 couple. You may be able to file for annulment. AVIOD face to face contact with him. He could try to trump up an assult charge . If you must meet do so in a public place and take a friend . If you haven't already get your evidence into a safe place. How long have you been married ?

This will not be over quickly. You will not enjoy this.

Just wait until they contact you, then go in and tell the truth.

You cannot deport anyone, you can't even threaten it. You can withdraw support and your sponsorship by sticking to the truth.

Sorry it didn't work for you, this is why the system is so difficult.

I think you should wait before doing anything. A cool down period is the best in this cases. Believe me, I have been through hell with a divorce I didn't even want in the first place. I know you feel betrayed but obviously you love this man otherwise you wouldn't have married him. If in a month you still want to withdraw the AOS it's your decision but be aware of all the consequences for him.

Sorry this has happen to you. You have no reason to be embarrassed people get used for green card more then we would like to think. It takes a sick person to ruin some one else hopes and dreams. If there anything good out of this it is that you found out while you are still able to do something about it and not the day after.

You do need to pull your support and do notify ICE of the fraud remember as much as you hurt you need to protect yourself. Good luck to you

Ummm no. SHE cannot deport him and SHE cannot cancel HIS application. She can pull HER Affidavit of Support which will cancel the application because without support, he cannot adjust.

OP - you should report him to ICE and if you have the emails as proof, provide them. He may still attempt to adjust status by claiming abuse so you need to make sure you report him so it's harder to do so.

Thank you everyone for kind words of support and advice. I called uscis and they said I need to cancel the 129F which would in turn cancel the AOS. I'm not sure I believe the rep I spoke with. Does anyone have the ICE number or website? I have searched and I can't find but mt head isn't on straight. Which office would I pull the Aff of support with? The AOS was transferred to CSC recently, I am thinking there. Thanks again.

no, she clearly says he is talking to a woman from back home. He has had biometrics done here. He can not work.

She is the one working and US citizen.

Send a letter to USCIS, state the facts and file for an annulment or divorce which ever you can do in your state, you can sue in civil court also. Attorney might help. Try to have him prosecuted in us for FRAUD.

Thank you all again. I reported him to ICE...and also his sister who is a permanent resident in another state, the emails have revealed that she was in on it too. I am taking tomorrow off from work to do all the paper work to send to cancel the aff of support and anything else I can. I have never been in this situation before and I thank the VJ community for all the support. I am trying my best to keep my eyes wide open and do everything I can to make sure he cannot hurt me anymore.

OMG this is so sad... God be with u.... it is so sad to see anyoine get used... dont believe him he probably planned on leaving u afeter he got his green card then marry his baby momma... i hope u made a copy of all them emails...anyway u should write a letter to USCIS and let them know of ur discovery and his fraudulent act. i would also send them copies of the email and ask them to send him back to his country... i wish u all the best DONT BELIEVE A WORD HE SAY..

Yep most definitely pull the I-864, that is very important. Make sure you get confirmation of you pulling it. Whether it be a stamp or a signature or SOMETHING.

I'm so sorry to hear this... Please, do what you need to do NOW before he tries to persuade you again and LIE to you even more. I've been with a man similar to him and I was fooled over and over and over. I was stupid enough for giving him chances after chances, but I eventually woke up from the truth and had the courage to let go and move on... I wish you strength to face this, it's tough...

MY HUSBAND GOT BIOMETRICS AND EAD IS PENDING. AOS IS BEING PROCESSED OUT OF CSC, SENT IN MAY. CAN I STOP THIS PROCESS? I NEED TO GET A DIVORCE OR ANNULMENT, POSSIBLY FOR FRAUD. PLEASE HELP

I am very sorry this has happened to you. I am very glad though you do not seem to have believed his sorry excuses and lies. Move on with your life girl. Honestly. Contact USCIS and tell them you wish to cancel the AOS, tell them your story, anything to make it possible so you are not liable for him for his affidavit of support. Good luck and best wishes!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.
