Hi all,

The 2006 US poverty guideline states that for size of family unit of 1 (my girl), my minimum income has to be $12,250. Well, I make well over that figure. So, do I need to show my saving in my bank, my house value, mortage, etc? Or my annual salary is enough? I just don't want to show too much if my income is way pass the minimum.

Fruto, please note that Brazil requires petitioners to be 125% above the poverty guidelines, and not 100% like most of them. Also, if I'm not mistaken, I believe you should count both you and your fiance to be supported by your income, which would make 2.

I only offer advice - not even legal. Just the plain and simple kind.

So that figure increases to $16,500. My income is still way over that figure. Do I need to list other assets even though they are not neccesary?

You must answer all the questions on the form that are applicable to you regardless of your income .. Things that don't apply be sure to write N/A and not leave them blank .. :star:

You need not answer questions that don't apply, you can put a zero on the lines like assets, this will also save you from having to provide additional documentation. Assets are needed when you fall below the 125% poverty line threshold. You should provide the letter from employer, showing nature of job, full or part time, salary, temporary or permanent...

Thats interesting as i specifically emailed the Vancouver Canada consulate and asked the same Question as my Fiance ( the USC ) is far above the income requirement for our family size .. They replied by saying .. Answer all Questions that are applicable. They didn't give me the impression it was ok not to disclose other information. I suppose it's possible that you don't have to disclose assets if you don't need them to meet the guidelines .. but to me it seems odd to just leave questions blank when they have answers ? Thankx for correcting me though @ any rate ..

On another note .. I would be curious to read some I-134 info that says if you meet the poverty guidelines by income alone you don't need to answer the rest of the Questions .. The instructions that come with the form don't say that .. So if anyone knows where to find this it would be appreciated ! :star: Cheers

Robin,

You're unlikely to find such a statement, in part because submitting I-134 itself is optional. The one and only financial requirement for a K visa is that the visa applicant demonstrate to the satisfaction of the consular officer that they will not become a public charge after entering the USA. How they do it is up to them. They can provide whatever they want. If what they provide is considered adequate they get the visa. If what they provide is considered inadequate they will be asked to provide more.

If asked to provide more there is a choice to make, provide it or not, recognizing that if the choice is 'not' then visa approval is seriously at risk.

See DS-2000, and note the frequent use of words such as 'may' and 'wish to'. A nicely formatted version of DS-2000 can be found here.

If I don't have life insurance or other personal property, should I just leave that field blank or I need to put "NONE" or "N/A"?

YOU HAVE TO WRITE N/A.

I thought this was answered before, In my case I make 45,000 per year, that is sufficient to show that I am above the 125% poverty line. My savings account is some where around $10 the savings pays such poor interest that I invest in other things, and need not show them on the form since my income is enough by it self, I put zero on the other lines. Less running around for additional documentation.

Note read the instructions included with form I-134.

II. Supporting Evidence.

As the sponsor, you must show you have sufficient income and/or financial resources to assure that the alien you are sponsoring will not become a public charge while in the United States.

Evidence should consist of copies of any or all of the following documentation listed below that are applicable to your situation.

Failure to provide evidence of sufficient income and/or financial resources may result in the denial of the alien's application for a visa or his removal from the United States.

The Sponsor must submit in duplicate evidence of income and resources, as appropriate:

A. Statement from officer of the bank or other fincial institution where you have deposits, giving the following details regarding your account:

1. Date account opened;

2. Total amount deposited for the past year;

3 Present balance.

B. Statement of your employer on business stationary, showing:

1. Date and nature of employment;

2. Salary paid;

3. Whether the position is temporary or permanent.

C. If self-employed:

1. Copy of last income tax return filed; or

2. Report of commercial rating concern.

D. List containing serial numbers and denomination of bonds and name of record owner(s).

Note: Where the instructions says and/or the "OR" means can be one or the other. If your income is sufficient provide them with the evidence that they need, example Copy of last 1-3 years tax returns, past 6 month's pay stubs, and letter from employer.

The letter from the bank is optional, same goes for Stocks, bonds, assets... Those items are only needed if your income is below the 125% poverty line when including your dependents, and beneficiary.
