Hi again folks.

Got our interview for AOS coming this Monday and were getting all documents ready.

With some luck I'm hoping to get the 10 year GC and not the 2. I've got all the documents ready for the interview eg - birth certs, photos,marriage cert, I-94 etc, the usual standard stuff. Below is the documents I have in which I'm hoping will swing the 10 GC. Does anyone think It looks good, or Is it not enough?

Gas & Electric bill in both names

Joint bank account

Water bill in both names

Car insurance in both names

House lease in both names

We do have other documents and bills that's in our names to show same address but both names are not on it eg - I have a credit card but my US Citizen wife's credit score went t1ts up after she got involved in a bad car accident 3 years ago, DirecTV is in mine, cell phone is in mine.

I know the USCIS like to see a lot co-mingling financial wise and as some of the bills is single and not joint, we hope this might not cause an issue.

None of these things will "swing" you to a 10 yr card versus a two year card. The item that "swings" you to a 10 yr card is totally out of your control. It is the age of your marriage at the time the greencard is approved.

Marriage:

1) less than 2 yrs old = 2 yr card.

2) more than 2 yrs old = 10 yr card.

Period.

None of these things will "swing" you to a 10 yr card versus a two year card. The item that "swings" you to a 10 yr card is totally out of your control. It is the age of your marriage at the time the greencard is approved.

Looks good to me.

Yes, the 2 year marriage test is usually the determining factor for the 2-yr vs 10-yr GC but, if I'm not mistaken, there is a conflict between the 2-yr marriage requirement to receive a 10-yr GC and the requirement that a K-1 AOS to a Conditional GC. At least that's what I've seen here on VJ.

no conflict, the OP is not adjusting based on K-1 status but based on an I-130 petition as an immediate relative of a USC

I see that now. I guess he was writing as I was and, yes, that would remove the K-1 conflict.

You have to understand that being married so long you will be judged as if you were ROCing so prepare enough evidence as if it was that. They expect more from a long-term marriage then they do for freshly married peeps.

Not usually no. That's called a "stokes interview" and that's when they suspect fraud. Normally that's a second interview. I'm just saying evidence wise someone AOSing can get away with a joint bank account only (better to have more but possible) whereas ROC is more hard core. My list (filing in April 2012) is this:

o Copy IRS transcripts 2009, 2010 & 2011 showing joint filing

o Copy Car Insurance cards (showing joint names)

o Copy Wells Fargo joint account

o Copy First Trust & Savings joint account

o Copy Verizon cell phone bill (showing joint names)

o Electricity bills (showing joint names)

o Health Insurance showing joint names

o Copy Drivers licenses showing same address

o Photos from wedding & various occasions

This is the stuff that's on my list as "if we have them"

o More stuff showing same address

o Letter from USPS showing joint names on post box

o Wills & Powers of Attorney showing each other as beneficiaries

o Flight records showing both travelled together

o Birth certificate of any children

o Lease/Mortgage agreement

o Affidavits from at least two (2) people who have know both of us since obtaining LPR
