Also, for as long as the Philippine congress and the senate are populated with chauvinistic and narcissistic politicians there is no way Divorce will be legalize (what will happen to their ego and machismo that's boosted by the number of mistresses they keep) and add to that the ever meddlesome bishops, cardinals and priests.

i agree with that 100% however, what about the Muslim population?????

they are free to divorce. i spent alot of time on Mindinao and i have learned this is the truth.

why is this??

Hey Markie!

I was watching it with my husband last night. It is ridiculous if you think about it. But you have to remember that she is still married to her husband and carries his name, so the kid even if he's not the father will carry his last name because that's the last name the girl is using.

It is not easy to know all the legalities pertinent to ones situation but at least know the basics. Like they say ignorance of the law excuses no one. In the Philippines her case was pretty much straight forward with the pregnancy being the evidence. To me her story all boils down to ignorance. Had she immediately consulted a competent lawyer upon receiving the summons they might have avoided it. In the Philippines the justice system is slower than a turtle's speed but money talks and when it does it goes a long way.

I understand it is a technicality...that the child would carry the husband's name...since the wife is still married to him. However, with regards to paternity and custodial rights, I don't believe the husband should be included. The husband has absolutely no part in creating that child, whether or not the husband wants to be a part of the child's life.

Let us examine at another angle. Suppose the husband impregnates another woman. When the child is born, does the child belong to the wife? Or to the woman? If the child belongs to the woman, and not the wife, what name shall the child take? It cannot be the husband's...because he is not married to her.

Again, this is a legal technicality...which makes absolutely no sense whatsoever, IMHO. I understand the Family Code of the Philippines was intended to protect the family...especially a helpless and innocent child. However, I believe it seriously needs to be amended to be just and fair for ALL parties involved. I definitely agree with gearman. Where is the separation of Church and State? In reality, the Philippines does not distinguish between the two. Philippine law is mostly governed and influenced by what the Catholic church says.

Im sorry but your post can easily be considered illegitimate.

No one looked down upon the man or the woman in this case.

Lets be honest Love is Love and it happens at all the wrong times in some cases.

You stated the law was there to protect the status of the child. Whether being legitimate or not.

Are you kidding me???? There is currently a population growth crisis currently in the Phils.

No one cares about the legitimacy of their children anymore. The mothers nor the fathers are concerned with this issue.

Philippine official claim that if this population growth is not controlled soon they will not be able to feed all the people

in the next 20 years.

80% of the children being born in the phils is currently by unwed mothers.

Now for my opinion of what needs to be done.

Regulate the control of the Catholic Church in the Phils!!!!!!!!!!!!!!!!!!!!

The Catholic Church does not allow Divorce and so says the Philippine Law.

If this couple was allowed divorce then this episode of locked up abroad would have never existed.

Freely distribute birth control Pills!!!!!!!!!!!!!!!!!!!!!!!!!!

The Catholic Church is against it!!!!!!!!!!!!

There are so many other Catholic rules that have been converted to Philippine Law.

Thats Just my opinion.

Muslim is another ballgame. They follow their own religious law more than the law of the country. Strange though...

I didn't say it will never be allowed, but with the kind of politicians the Philippines have, I seriously doubt it at the moment.

Muslim unions are governed by Shariah Law, I think.

However, with regards to paternity and custodial rights, I don't believe the husband should be included. The husband has absolutely no part in creating that child, whether or not the husband wants to be a part of the child's life.

See there lies the complexity of it. The woman and the father of the child will have a difficult time fighting this because of the adultery charge and since the baby is the evidence of their crime, will they want to be with their child or end up in jail?

In the Philippines, as you know all illegitimate children are under the care of their mother and uses her last name although in recent years if the father acknowledges the child then the child can use the father's last name. So in effect if the man acknowledges then it will be under his last name.

There is really a double standard. One sexual intercourse by a wife other than her husband is already adultery but concubinage [husband commits marital infidelity] can only committed by a husband if he keeps a mistress in the conjugal dwelling, or has sexual intercourse with a woman not his wife under scandalous circumstances, or cohabits with his mistress in any other place. ALso, adultery carries imprisonment of 7-14 years while concubinage carries between 6 months to 2 years.

Where is the separation of Church and State?

As provided for in our constitution there is a separation of State and the Church, that's clearly stated. But you see the Catholic church love to dip their fingers into the State's affairs. To me it is very hypocritical that they are staunch crusaders of what is moral when the Church itself has an issue about priests molesting innocent children, or have maintained or had relationships with women and bore them children while serving the Catholic Church. I mean...SERIOUSLY NOW!

These typres of archaic laws, regarding adultery and/or birth control, still exist in 3rd world countries and countries that are very religious.

For example, in my wife's country (Costa Rica), there was no sex education in school (very recently they have started I believe) and seems like most teenage girls have kids.

Another one is that if a woman claims you as the father, you are pretty much the father unless you can prove yourself not to be. It takes about 6 months and a lot of money for lawyers, DNA tests, fees, bribes, etc. During that 6 months, you have to pay child support on the kid.:wacko:

I don't think this does very much to the man in the long run, He could just abandon the marriage . I doubt the court system works well enough or they have any type of child support system . No law stopping you from just leaving your wife, if she ends up having a kid by another man. No one is going to force you to support a kid that came from another man

Hello everyone!

So I just finished watching Nat Geo's Locked Up Abroad Forbidden Love. Very interesting Philippine law: If your wife is impregnated by another man; technically, the baby belongs to you, the husband. DNA results, to prove paternity, are irrelevant in their courts of law.

I don't know...I suppose I'm on a different wavelength. But I think that is complete BS. Of course, I don't believe in extramarital relations. But a baby, born outside of marriage, belonging to someone who is NOT the father? This seems illogical, to me. :unsure:

What do you all think of the issue?

80% is really high. Its shows promiscuity and immoral behaviors of our fellow filipina. Where did you get this 80% data? I want to challenge your 80% data.. I still believe that we filipinas have morals and proper upbringing.
