K-VISA-WAT IF BOTH MET IN 2 YRS BUT NT ENGAGED

HI ALL

I GOT D PREVIOUS ANSWER THAT IT IS VERY NECESSARY TO MEET IN PERSON IN THE LAST TWO YEARS.

NOW MY CASE IS WE MET NEARLY 3-4 YRS AGO.

AS WE WERE KNOWN TO EACH OTHER THROUGH FAMILY THING.

OUR PARENTS DECIDED TO DO FORMALISE THE THING.

THEY DID A KIND OF CEREMONY IN INDIA BUT WE WERE NOT PRESENT THERE. MY FIANCEE WAS IN U.S ND MYSELF IS IN LAGOS WHERE IM STILL LIVING. WE HAVE ALL THE SNAPS OF THAT CEREMONY.

NOW IF WE BOTH GO TO INDIA , SPEND THERE SEVEN DAYS OR SO BUT OFFICIAL ENGAGEMENT WILL NOT BE THERE AS OUR PARENTS MAY NOT BE PRESENT IN INDIA THAT TIME.

THEN CAN WE APPPLY FOR K1 OR NOT. DOES PREVIOUS CEREMONY GIVES ANY WEIGHTAGE TO THE CASE????

10/23/2006 - Case Transfered to CSC

10/27/2006 - Case received at CSC

11/09/2006 - E-mail recevied from CRIS saying AOS Approved and welcome notice mailed.

11/14/2006 - An approval letter mailed.

11/15/2006 - Green Card Received !!

8/21/2008 - Package delivered.

Timeline

The requirement is that you have met at leat once in the past two years. So yes, your going for a visit for a week or so is fine to satisfy the requirement.

They do not care how you got engaged, only that you are free, willing and legally able to marry.

Now, what I cannot answer is whether or not only seeing each other once in two years will reflect negatively at the interview - someone with more experience will have to answer that.

Jul 5 - Receipt date for I-130 petition for my over 21 brother and his wife (both in the UK)

Feb 23 - Sent USCIS a message asking for a processing update

May 6 - Received an email response saying things were progressing normally but that waiting times might be longer

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing

I'm not quite certain what you're asking. For the I-129F, the requirements are a) both parties being free to marry and intending to marry and B) having proof of having met once in the past two years.

Having a formal engagement ceremony is neither here nor there. You're not proving that you're engaged by the rules of your culture or anything, just that you intend to marry once in the U.S.

Now, being able to say that there was a big formal engagement party back in India would help paint a picture of an ongoing relationship. But if you and she meet in India and your parents aren't there, that's not going to make any difference to USCIS.

GGT, your posts are all over the boards and it is making it impossible to have a conversation with you. I highly recommend that you keep all your questions together so they can be properly answered. If you want to use the message baords, you have to cooperate a little. also, writing in all capital letters like that is internet SHOUTING and is hard to read.

You and your USC fiancee must simply see each other in person, now, and have evidence to show it. Full stop. USCIS does not care about your ceremonies at this point--official Indian ceremonies are not part of the "engagement" process for the US. It is simple: see each other in person. THEN your fiance can petition you.

Meet in Africa, meet in Europe, meet in India, it does not matter. Just make sure you save proof of meeting in person.

Good. Sounds like you are planning on meeting in person before filing.

Meauxna said it, and it bears repeating, that you must document this visit well. Boarding passes, passport stamps and visas, travel itineraries, credit card statements showing payment for plane tickets, PHOTOS (one VJ member even took a picture of the two of them together holding up a newspaper - showing a date - to submit for evidence), hotel receipts, restaurant receipts, emails planning the trip, all help to prove that you have, in fact, met each other during the required time frame.

Best wishes, and I hope you have a romantic visit despite your compulsory agenda (I bet your future bride would really appreciate that, too...).
