Hi everyone, just had a few questions...

We are currently adjusting status from a k1 visa and are trying to understand how we are to go to our future interview with a bank account in both our names without being able to open a bank account together since my husband doesn't have a SSN. I called the Social Security office today and was told that a Social Security number was only to be used for work purposes and since he does not yet have his EAD, we aren't able to apply for one.

K1 Timeline:

9.10.10 - Mailed I-129F

9.14.10 - Received in Dallas, signed for by L. Walker.

9.20.10 - Check cashed

2.7.11 - NOA2 via email

3.31.11 - Medical interview

4.4.11 - Mailed packet 3 and paid visa fee

4.26.11 - Visa interview appointment, 9am

4.26.11 - Visa APPROVED!!!

5.4.11 - Visa delivered

5.25.11 - POE: Chicago

6.5.11 - Wedding in Omaha

AOS:

6.18.11 - Mailed AOS/EAD/AP

6.20.11 - Received in Chicago/check cashed

6.27.11 - NOA1 recieved for all three (AOS/EAD/AP)

7.26.11 - Biometrics appointment, 2pm

8.4.11 - Transfered to CSC

8.11.11 - EAD approved!!! (checked website)

Did you ask if they would accept his passport number? When I was an international student here, I opened a bank account with my passport number. So did many of my fellow students.

Also, the SS office might not be familiar with the K1. His I-94 is still valid for about 2 months so it might be worth a shot to apply for a SSN anyways.

Some main stream banks like Bank of America do not require social security number to open an account. Unless something has changed recently I know 4 years ago they were not requiring one. But I know the caught alot of hell over it. I would suggest checking with them

You can get it with a K1...but you have to be aware of the timing of it.

It might be just as easy to wait for the EAD or GC. Or try another bank. But you don't need to have a bank account in both your names for your AOS. My husband and I had nothing but our marriage certificate and we were approved quickly with no interview.

The told me to get ITIN (indivual taxpayer ID number). You can only apply for that when you file taxes and claim the person. So, i did. took IRS 4 months to do my taxes and I had them in early. got the certified copy from IRS, went back to the bank and they say no. Now they say I was told wrong. That a foreign National can not have bank account here.

Timeline

Once he has been here for 2 weeks you go to the social security office and take the passport, any ID and birth certificate information and ask for a social security card. The K1 Visa is considered a Working Visa so they are, by their own rules and you can find that here also, supposed to give him one. Me and my husband have a joint bank account with suntrust and I dont have a ssn.. I don't even live there yet. We opened it last year when I was visiting. :)

K-1 visa holder is elegible for SSN but he must apply for it before his I-94 expires. Go to the office to apply and if they say that he can't get one, ask for their supervisor.

Thanks for all the help! The bank I'm a member at says a person without a SSN cannot open an account with them. I'm going to check around now though. Does the I-94 expire when you get married or just by the date written on there (in our case, August 23rd) ?? Either way, I think we may just go ahead with everything else (adding his name to household bills, getting his driver's license...)

The I-94 expires on the date written on it. You have time to get an SSN. Go to a local Social Security office to apply.

I just read and used the information on obtaining a Social Security number in "Guides" here on VisaJourney. I double checked the info here with the SSA website and forms. It was very helpful and we had no problems. We went to the office 12 days after my husband arrived in the U.S. on a K1 visa and received his card about 3 weeks later.

My husband(US Citizen) and I opened our joint account at TDBank. I don't have a SSN yet, they just gave me W9 form to sign.

Timeline

about 2 1/2 weeks after POE date,

get to SSA office, apply for SSN but

ask clerk to look up in SAVE database via A# and/or VISA name. If not found, retrieve application, come back in 3 days try again.

IF cannot find on A# or Visa Name after 6 weeks of being in country, is some issue with the SAVE database, and ya get that fixed (in person) at a CBP secondary inspection / deferred inspection office, then come back to SSA office about 4 days after fixing name at CBP.

With me so far ?

Once yer certain is a record on the K-1 visa holder in the SAVE database based on lookup by SSA clerk,

let the application proceed.

Come back the NEXT DAY, can get the #, and usually within 2 weeks, can receive SSN card in postal mail.

Also - please note that most SSA employees sitting at the desk are brain dead, not properly trained - so if WHEN you mention SAVE DATABASE LOOKUP and their eyes glaze over, ask for the shift supervisor, start over with them. Be Kind and Firm.

SSN in hand? go handle yer banking business with the bank, smile much about the Patriot Act, ask for free coffee whilst yer there.

Nota.Bene.: Calling on telephone to inquire of any SSA hotline is useless, they have less training on this stuff than the clerk across the desk.

So they turned his acct into a joint account.
