hey everyone,

me and my fiance are planning on filing for the k-1 visa next week. next week will be the end of june and I looked on the USCIS site for the updated and proper forms to download and fill out and the expiry date is the last day of june. im canadian and im the beneficiary so the papers i need to fill out are saying online that they will be expired by next week. I dont understand, thats all they have online and if i fill out those biography papers that i need to fill out and send them in to my fiance for him to file for me will we be denied because the papers are expired? i wish USCIS were better at updates on this.

please let me know if you know the answer to this! thank you very much!

OMB expiration is not important. What you want to look at is the current edition that they are accepting and also if they are accepting previous versions as well. For example:

Form............................Form #......Fee.............Version......................

Biographic Information.....G-325A.......$0......06/12/09. Previous editions accepted.

If you look at my timeline in my signature, you will see that we originally sent our petition in January. It got lost somehow and after months of calling to see where it was, we just resent it, not seeing the expiry dates on the forms. Look again at the date of our NOA1 and notice that it is more than a month after we refiled, (also more than a month after they cashed the cheque)

We received a call a few days after sending in the petition, telling us that our forms were expired, and that I also needed a newer passport photo, remember, my original one was for January, not for March. So we scrambled to get this form together and a new passport photo, I paid through the teeth to send it to my fiance ASAP, and he as well to send it to Texas. What a mess. Ignoring the January mishap, had we sent everything in without it being expired, I would have gotten my NOA1 in the end of March. March filers are starting to receive their NOA2s on the site already, and we are listed now as a May filer, though my March buddies still consider me one of their own.

my thoughts to you? Either fill out the form and fedex that sucker to arrive before it expires, or wait until after it expires and download a new form and send that one. You never know what they consider to be needed at any stage of the game for certain, as my fiance was also asked for us to send in some things that are normally not even needed until packet 3, and the interview. Also, apparently the USCIS NEVER phones you according to this site, though having had a phone call from them, and confirmed it when we called them back over the few days following, we know that's not true all the time either.
