I have a question guys. What if you refile and that time you already exceeded the two year requirement for divorce. Can you still qualify for vawa?

I filed on July 30th, received Prima Facie immediately after that.

On May 14th i received RFE for good moral and abuse

I responded to Good moral (they brought up an arrest i had in 2005 which was SEALED by the court with a violation and NO CRIMINAL CHARGES), i sent evidence to that.

I responded to Abuse with a detailed statement and letters from a Psychiatrist saying he treated me after diagnosing me with post traumatic stress disorder caused my abusive wife, what he prescribed, and that he treated me with reality focus therapy.

I also had 3 statement from 3 witnesses.

If my research is correct, base on this example. if your marriage was terminated on January 5, 2000 you can still file for vawa until January 5, 2002 plus you need to show that your divorce was connected to the abuse.

Vawa is for both man and woman. I'm a guy and my vawa case got approved last month. They may use ur previous criminal case against but then again u never kno wit those ppl. Good luck

Hey bogoss83.

Am a female and my vawa got approve last month june.and what year did u file.can u plse write down ur time line,at the signature section.i had 5 or six witness to write me a letter for immigration.i also had a traffic voilation but I went to court and the problem was ok.i ave a very gud lawyer too even doe sometimes I get on her last nerve.(i ask her too many damn questions)lol.

Check out the forum "Bringing Family Members of Permanent Residents to America." It will take approximately 3-4 years given the current processing times.

a) certificate of disposition from court showing case was closed/SEALED convincted of a NON-CRIMINAL offense

b) statement from Psychiatrist saying he saw me in several sessions and i was suffering post traumatic stress disorder and anxiety from abusive wife who kicked me out in the street, threaten to deport me saying shes a white girl and would be believed and would send me back to my country in a box and on and on for months and month

c) 3 statements from friends who witnessed what she was telling me and doing to me and they are supporting me financially right now

d) showed evidence how my life was stable before the abuse and lived in the same house for years but now i moved 3 times in less than a year

e) showed good moral with IRS statements (good standing), good credit, volunteered during hurricane WILMA, donated to red cross etc...

waiting stressing out... been in the US since 2001 and my marriage was 2yrs+

. They don't discriminate against man. If you have a solid case they will approved you. Do you have a lawyer? Good luck...

I filed a new I-485. The only thing i get so far is Receipt notice. I-485 processing times are based on your local office case load and staff level.
