i had my I 485 interview first week of this month IO took my i-94 as well, she even asked me about the abuse.. Which of course like you the question stressed me out.. Few questions about if i was convicted or was a member of a gang.. The IO seems very nice but still i wouldnt know.. So dont worry youll be fine.. I just got the card production email few days ago.. The IO didnt say if i am aproved or what the day of the interview. She just said that i have to wait within 30 days because they have to review ..

My IO is not as nice, I can tell the IO is trying to find grounds to reject my case but didn't find any problems in the interview because everything is clean. So I went through a rather tough one.

Did it take you about 3 weeks to receive the "card in production" e-mail?

hey everyone, im new in here and i have really big problem. hope someone can help my VAWA case.

i filed my VAWA on February 2011. After 2 months i got a Prima facie determination and they also gave me the EAD card around August. But on Sep 22, they sent me addition request of evidence. They need me provide my husband citizenship information (like passport copy, birthday of cert etc....) but unfortunately my husband disappeared a year after i got the order of protection for criminal court. nobody can find him (even police,lawyer and private investigator).

i dont have much information about him. i just only have his SSC, driver's license no., but they all cant help me to prove his citizenship.

Anyone know how can i get what citizenship he is?

How long i need to respond what USCIS request

do u think i can call USCIS to get help coz we didnt divorce, i still his wife(even he disappeared)?

if i cant provide what citizenship he is, what USCIS do for me?

11/04 I485 touched (still on initial review)

11/21 officer called lawyer about the I485 (btw: really nice IO)

12/10 apply for VAWA, without background check

12/11 lawyer drop off a copy of I360 for the IO

12/15 Prima faice received

12/18 sent background check, also sent a letter to IO asking to expedite the I485 to vermont to be linked with I360

12/31 I360 touched

08/04 Apply for EAD renew

08/18 receive NOA

08/26 new card ordered

08/31 new card ordered (again??)

09/01 notice of approval of I765... (where is my VAWA approval??? God help me...)

09/03 EAD arrived in the mail!! ufa!

10/03 Sent letter to renew prima facie and inquire about vawa status.

10/05 I360 touched- changed to "Request for evidence review" (WTH????)

11/27 Recieved prima facie extension

11/30 VAWA APPROVED!!!! yupiiiiiiiiiiiiii12/04 I360 Touched

12/22 Interview noticed for 01/23/12

12/26 Interview canceled by USCIS

12/31 New interview notice for 01/30/12

to day I received an e-mail from USCIS that they have mailed me requesting additional evidence RFE. I had applied for VAWA in end January 2011. . I do not know what they are asking for. i will wait till received that letter, but some body have same this situation and experience ?

He original from Philippines and moved to Texas when he was 10 years old but back college to his country. we met in New York. That all he said, i dont know that is trust or not because he lied on me a lot. I already have lawyer but she doesnt know what she can do. when we on criminal court for domestic violence, the judge asked him about citizenship, he said "he is citizen". that's y i called my D.A., she might provide the count record to prove his status but she also said that might bot help because the immigration said, they need citizenship evidence.

i called the immigration dept today. they transfer to VAWA immigration dept but nobody pick it up and i left and message. i dont know when they reply.

do u know which immigration dept will handle it? do u think they will help me?

Giveusfree You welcome,yes there ,on the website of uscis go to check case type in your receipt number then at the bottom check the processing time you can check on office click VERMONT type of form choose I-360 then that info will come.

Don't feel despair and sad...things will work out...you have come too far to be sad. I'm sorry your interview was not as easy. They did take my I-94 a few years ago when I went with my spouse. It is a must that they take it from you. Keep praying, you will get your approval letter very soon in the mail. You should have ask for a supervisor, under no circumstance should they ask you anything related to VAWA. VSC has the sole authority to adjudicate this matter. Please know your rights. It was written on the face of the file that your IO had in front of him.

Anyways, I did get my card exactly 12 days after my interview, but my love affair with Uscis is not over. I had to return the card. everthing was correct except it stated that I am a residence for many years...longer than I have been in the US. So, as you all know I have to wait for a new card...that will take some months. But God be the GLORY. I am a US Resident after all my pains.

All my friends waiting, hang in there, you too will have your day of great reward...

Since the IO can't ask us about the abuse, can someone help me how to say that I need to speak to your supervisor without me sounding rude, since English is not my first language sometimes when I speak English people tend to judge me that i'm mad or something. lol

Welcome to the vawa forum.I hope this will help with your situation.Are you still married to your husband if yes though seperated as long as you arent divorced you can get his birth certificate.If you know when he was born (which i think you do) and where he was born ,his father's full names and his mother first name and her maiden name you can request his birth certificate by law if you still married you can obtain it.Thats how I got my husband's .I called the vital records in the state where he was born ,gave them the detail I just mentioned.They asked me to fax them a copy of my id,marriage certificate and ssn and I paid like $42 and within 4 days they delievered it through ups .Hope it will work for you too.

Sorry didnt realise he was born in philippines .I think the only way is to have a copy of his naturalization.That can help to prove his USA citizenship.At first when I apply for vawa I used his passport copy and driver's license.But I got his birth certificate because the interview letter asked me that even though the IO didnt ask for it.

my case was touched again on the 18th oct.It says response to RFE review & that i'll hear 4m them on or b4 60days.Why haven't they send me biometrics appointment anymore?or does previous biometrics still count even though its been years ago?In my previous application, i did everything(got fingerprinted multiple times,they even automatically rescheduled one of my interviews due to hurricane) & i went to d last interview myself-this has been yrs ago.This time around,i filed I-485 along with I-360,i did not get no prima facie,EAD or biometrics appointment as at now.All they say is they will not adjust status until they receive the passports & I-693(that should be on the way now).I'll just wait & see.

Sasang...WELCOME.It is your duty to prove your husband's US citizenship status.Most vawa applications get denied b/c petitioner wasn't able to prove spouse's US citizenship status or LPR status.You should have added his Naturalization certificate b/4 u filed,ur lawyer should have told u that b/c that's one of the requirements.Ur case will not be processed any further & it will ultimately be denied unless u can prove his US citizenship status.If you filed form I-485 b/4 with your husband,u can request USCIS use that form to prove his citizenship status because that info will already be there.If a lawyer helped u b/4,they might still have ur file-so u can have ur previous receipt # & use that & explain in a letter to VSC why its so difficult for you to get his naturalization cert.Another way to prove his US citizenship status is to ask his family members-Mother,father,brother or sister & that's if they are in good terms with you.Goodluck & keep us posted.

I just received a card production order message, I can't Beleive it, it looks real,god is good. To those who are waiting stay strong don't ever give. Now I can seat back and think about all the thing I have been through for the pass 5yrs. I hope we all learn something from what is happening to us, I know i have, what I learn is to never give up and always believe in God. I'm pretty sure you do too. Now I can take a big breath and say to myself LIFE IS BEAUTIFUL....
