Hello everyone,

I just received an email from USCIS that they have mailed me a RFE. I had applied for VAWA in mid-Feb 2011. I'm really nervous now. I do not know what they are asking for. I hope I have it. I hope they look at my case positively. I'm scared. Does anyone have any tips/ideas about responding to a RFE? Please help.

hey don't be afraid,they asked me the same thing in MAY , IT was about the abuse,more evidence, I go through my story with my attorney again, and send to them in AUgust, now i am waiting, we need to see things positive , see there are some approval lately ,the only i wished my attorney would send to them earlier, I might have already gotten something,by the way does anybody know long long it take to get soemthing after you send the REFERENCE

HEY i know that we file about the same time last AUGUST, HOW is going with your case? i am waiting after send to them more evidence, GOD PLEASE help it takes really long

Hello Adele , thank you so much for your answer. The reason why I love this forum it is because we are all in the same boat and we all are experiencing the same situation.

I am following your case, ladyg etc because our approval days are very close to each other so If you haven't gotten anything then is normal I hadn't either :)

I am just afraid my attorney will not let me know on time. My attorney mailed me a copy of my notices (VAWA approval, I485 transfer) this past Tuesday and I havne't gotten them yet !!! I can not pick them up myself because the office it's 1:30 minutes away.

Well I will just wait but please as soon as you received your interview letter let us all know it will be really appreciated for all of us waiting for one too.

I haven't heard anything from them yet regarding the interview notice. Still waiting but i would take EVERYTHING you attorney tell you with a grain of salt.... don't believe that they know everything sometimes u do your own research and in this case, i strongly belive they are WRONG, everyone I know including my lawyer said the interview will be scheduled in a FEW WEEKS not 6months! Even if u call USCIS they'll confirm that unless there is something EXTRA SPECIAL about your case :blush:

Otherwise you are on the same track as Yullisa, Ladyg and many more, don't panic :bonk:

Im filing for an appeal. Basically i showed that i was battered. i lived with my spouse. video of us together, pictures of us together with friends. letters from family that shes been at family events. documentation that i have been a batter spouse. i have an extreme cruelty divorce. i gave them tax filings, our lease, showed she lived there. why i love my wife and our courtship they believe everything

They denied me based on that i did not show. "mutual property, insurance, bank accounts"

That is just........ impossible to fathom..We are filing an appeal.. i may even get a letter from my ex-wife stating that we were married in faith... but you know... they believe we loved eachother.. but its just not a good marriage in Faith? What the.. this has to be appeal i was denied unjustly.

Do not file for an appeal!! To win a appeal you have to prove that uscis did not follow a procedure or did something wrong. Do like a kimber did and refile it, it will be faster and you have greater chances.... Good luck

11/04 I485 touched (still on initial review)

11/21 officer called lawyer about the I485 (btw: really nice IO)

12/10 apply for VAWA, without background check

12/11 lawyer drop off a copy of I360 for the IO

12/15 Prima faice received

12/18 sent background check, also sent a letter to IO asking to expedite the I485 to vermont to be linked with I360

12/31 I360 touched

08/04 Apply for EAD renew

08/18 receive NOA

08/26 new card ordered

08/31 new card ordered (again??)

09/01 notice of approval of I765... (where is my VAWA approval??? God help me...)

09/03 EAD arrived in the mail!! ufa!

10/03 Sent letter to renew prima facie and inquire about vawa status.

10/05 I360 touched- changed to "Request for evidence review" (WTH????)

11/27 Recieved prima facie extension

11/30 VAWA APPROVED!!!! yupiiiiiiiiiiiiii12/04 I360 Touched

12/22 Interview noticed for 01/23/12

12/26 Interview canceled by USCIS

12/31 New interview notice for 01/30/12

01/31/12 Interview and new biometrics done!!!

Do not file for an appeal!! To win a appeal you have to prove that uscis did not follow a procedure or did something wrong. Do like a kimber did and refile it, it will be faster and you have greater chances.... Good luck

last August 2010. it has been for a while. i had a friend here she got a approval in MAY we filed the same time. she had already got a green card

I HOPE EVERYBODY IS FINE, CONGRATULATIONS TO EVERYONE WHO GOT APPROVED AND WHOEVER IS WAITING I WISH YOU ALL TO GET IT VERY SOON!!!

I HAD MY INTERVIEW ON AUGUST 2ND FOR ADJUSTMENT OF STATUS UNDER APPROVED I360, EVERYTHING WENT FINE EXCEPT MY COURT DECISION WAS "ADMINISTRATIVELY CLOSED" INSTEAD OF TERMINATED, SO OFFICER TOLD

US (ME AND MY LAWER) HE DID NOT HAVE JURICE DICTION OVER IT TO GIVE ME APPROVAL SO REFERRED US TO GO BACK TO COURT TO FINALIZE THE DECISION, WHICH WE DID ON SEPTEMBER 13TH,

WE HAD COMPLETED THE PROCESS AND I GUESS THE IMMIGRATION COURT NOTIFIED THE USCIS LOCAL OFFICE ABOUT IT.

I CHECKED MY ONLINE STATUS AND GOT THE FOLLOWING STATUS ONLINE:

Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Your Case Status: Card/ Document Production

On September 20, 2011, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.

ON SECOND DAY THE STATUS HAD CHANGED AGAIN AND IT SAID:

On September 21, 2011, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. Yes ofcourse you can get a GC through VAWA, based on an approved I360 petition. but you will be called for an interview.

Apr 12th 2011 Application for action on an approved petition sent
May 2nd 2011 Duplicate approval notice received
Sep 9th 2011 I485 and I765 applications sent
Sep 14th 2011 I797C NOA received
Sep 16th 2011 ASC Biometrics Appointment Notice received
Oct 14th 2011 Biometrics Done
Oct 25th 2011 EAD Card production ordered
Oct 26th 2011 EAD Card sent to my home address ( thank God!!)
Oct 28th 2011 EAD Card in hand. Thank you Lord
Nov 14th 2011 I 485 Case transferred to NBC to speed up processing.what does this mean???

waiting.....the whole year of 2012 passes by without a word!!

Apr 17th 2013 I get a letter asking for a I 864W form to complete I485 processing and its orange in colour

Sep 10th 2013 I 485 Interview

I wasnt approved that day, was given another date after the IO requested documents i had that were not very clear to her to be notarized by the court.

Oct 4th 2013 Went back to the IO with the requested documents and she said the decision will be mailed to me.

Nov 1st 2013 I got my I797C USCIS Notification Letter of Approval of my I 485

Nov 8th 2013 Green card got mailed to my address

11.12.13 received my 10 year green card. Thank God. Journey Complete

hi Hopeful-2011,

I went through the same, do not be afraid, they asked me twice for RFE, once right after i send the i 360, 2nd time after 5 month, as soon as I send my papers back whatever they were asking after 54 days i got aprooval.

Just be patient, it is the hard to go through, but we do not have choice......... good luck

I agree, Under approved I360 you of cause can apply for adjustment of status (GC), but you will have an interview

Hello everyone!

Thank you for your fantastic support. This forum has been a huge source of support and survival, I must say. I was totally broken after what had happened in my personal life...same story like the most of us. But I'm glad to find this forum and find some hope...and survive.

My lawyer got the RFE in his hands today. USCIS is asking for more proof on good faith marriage. I'd send them a bunch of pictures of the weddding event, honeymoon, joint bank accounts, wedding bills, and all the details in my statement. I did not have children with my spouse, so cannot provide more details on that front. Also, my husband was really dominant and wanted to take charge of things, so he did not include me on any other things like lease agreements, automobiles, properties...etc.

What should I provide to the USCIS to suffice their requirement on good faith marriage? Please help.....

Feb 18th 2011 - filed I360, I485 and I765

Feb 21st - receipt notice received

Feb 27th - prima facie received

March 18th - letter for biometrics appointment for April 15th

April 15th - biometrics appointment done

May 15th - EAD approved

May 20th - received EAD card

Sept 23rd - RFE received

Dec 14th - RFE response send

Feb 17th 2012 - filed for EAD renewal

Feb 23rd - received an email from USCIS: I360 APPROVED!!!

Feb 23rd - transferred my case to NBC

Feb 24th - receipt notice for EAD renewal

March 7th - RFE issued for EAD

March 13th - RFE response send

March 29th - EAD renewal approved

April 10th - received EAD card

I send pictures and little notes that he sent me when we just started dating. I did not have kids with him either but I was married to him for 7 years before filing for VAWA maybe this helped I don't know. I did not have mutual property with him but I sent some paperwork of him from his ex jobs where he signed me as his wife, then I just sent a lot of pics, our wedding was small, just 5 people !! but I sent pics of this too, then of course insurance policy bills, even though I was not allowed to drive he had to sign me up for his insurance and of course letter from friends stating that they knew of your marriage , I did not have join bank account , I have never had a bank account so I think this is one of the strongest proofs you have!! :)

Try to show also that you and your spouse intended to create a life together, example plans for future, planning to own a house, have a family business someday and etc. hope this helps
