Soorry why refile and not appeal... Can u guys explain it.. I am scare ... Please somebody help

yours was denied too?? I'm sorry to hear that... For what I read usually appeal rarely gets overturned... However if you refile your chances are better! Kimber just got an approval after refiling... You will need to address all the points that they find it wrong in your first petition. good luck

hey guys i have been following your forum, i just got a decision but it just says decision i see many of you saying approved etc,. my lawyer hasn't received it yet.

im scared but im wondering if that normal when you check your eac using the uscis site?

Uglyman, you need to refile asap... do not appeal!!

Hey guys, i got an email notification saying my I485 has been transferred a USCIS office......what does this mean?????

Your case is transfered to your local office so that they will schedule an interview. So the next correspondence from USCIS will be an interview date for you :dance:

we all asked the same question in the previous page (Anxious and I are on the same timeline right after LadyG so she explained to us that the next letter (in 2-6 weeks) will be an interview notice. Am also anxiously waiting for mine because my i485 was transfered on 9/15 :star:

Hello everyone, I need your help. As I said before my VAWA was approved a month ago and as soon as I received the approval notice I mailed all the paperwork to apply for a new I485, I765 and I131 with a letter asking that the fees be waived based on a previous collected fee. Today I just received all my paperwork back saying that they could not accept my application because of the wrong fee sent. Now I am wondering if I will have to pay the fees again for a new application or if they sent it back because I did not send a copy of my old application receipt notice. My old application/ case was closed/ denied because I got divorced before I went to the interview and then applied to VAWA. I wonder if they did not accept the letter to have the fees waived for the new I485 because the previous case has been closed.

I know that some of you have applied for a new I485 and sent the letter to have the fees waived. The question is: were your old I485 applications still open or pending at the time you mailed the new I485 with the letter or were your cases closed?

I am not sure what to do... maybe they just need a copy of my old receipts with the letter requesting the fees to be waived...hopefully thats all..I really hope I dont have to pay more than $1000 in fees again when I dont even have a job. Please let me know your experiences with this...Thanks a lot, Carla

Hello everyone. I just received a phone call from my attorney after almost a week since my applications were updated in the USCIS website. My attorney congratulated me for my VAWA approval and that now I only need to wait for the I485 interview which could be anywhere from 6 months or so!!! But from what a read here , after the VAWA approval the interview for the I485 IS ONLY SOME WEEKS AFTER. Now I am afraid that my attorney will not let me know on time about the interview and miss it !!!

I received this email on the 19th;

Your Case Status: Initial Review

The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now being processed at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

From what I read here , this means that the transferred application was received at the NBC, so I don't think it will take 6 months for an interview and I am afraid of not being able to gather all the necessary documents to take to the interview , please someone that have already received their I485 interview notice let me know what documents the ask for ?

Thank you and keep positive thoughts and pray a lot that justice is served for all of us that truly suffered in the hands of our spouses.

Same thing here. VSC returned new 485 package with the same message. Luckily that's after they sending me an interview note for my old 485 (based on 130). You never know what they gonna do. So my best advice is to include the fees and mail again.

You cannot make telephone inquiry about VAWA cases, you have to make a written inquiry signed by you or make an info pass via www.uscis.gov.

Depending on your state you can also contact your senator they can make inquiries on your behalf.
