To get back on track,

I think I saw it mentioned somewhere: VAWA (at minimum) requires proof of Mental Abuse

OR

proof of an act of physical violence suffered, while living with spouse in the US. My understanding was that if this second variation of VAWA is proven (i.e. spouse pleaded guilty in court to a physical attack resulting in injury (even if victim didn't seek medical treatment), then it was enough ground under VAWA, and no long-lasting effect needed proving. Am I wrong?

SingleDad Vawa Law does not require (at minimum) proof of mental abuse. You can file Vawa based just in physical violence suffered.

The individual does not need to seek medical treatment or have a police report to have the Vawa case approved. In your case your wife pleaded guilty in court to a physical attack resulting in physical injury. YOU HAVE A HUGE PROOF OF THE VIOLENCE SUFFERED.

You just need to prove in Vawa cases based in physical violence the violence suffered, NOTHING ELSE, and bonafide marriage of course.Some people suffered physical violence but never called the police, but the person has pictures of the violence suffered and/or statement from school teachers, pastor,priest etc...stating they witnessed the violence. Many Vawa filers didn't seek medical treatment after being battered and they had their cases approved.In your case your wife pleaded guilty in Court, and you had some restraining orders against her. You are good.

I totally agree with you SingleDad2usc. We are victims of spousal abuse, be it mental, physical, or whatever, and we are here to help and encourage each other. With all due respect HughCole, go ahead and start a seperate thread for your comments, I am sure you will have a couple others like you there to encourage each other as well. Each time I read posts like yours on this thread, it brings back the feeling of dread I had while living with my USC husband. I have suffered ENOUGH violence, and I can't go back to where I was...I have made some improvement, but all these goes to show that I will NEVER be the same again. I live in CONSTANT fear...please with all due respect, start a new thread. My daughter needs me, I have made huge improvements and I can't afford to go back.

Hey Everyone,

Macbook,Loveme,Lorphelpme,Myjay,Optimisticchic,memes....how are you all doing?I've been very busy working on my RFE...didn't want to rush anything,wanted to do a thorough job by taking time and gathering all the requested items..My attorney has been really wonderful drafting letters on my behalf and explaining everything.Now that i've submitted the paperwork, i feel relieved but then, there goes the praying & waiting again.I hope i don't have to wait too long this time.Congrats hopeful-2011 on ur GC approval.

And to everyone who is waiting, never give up.I think VSC will work faster after the presidential election-i hope we have a better legislative arm of govt this time as everything has been a gridlock with this congress.

So, keep hope alive and never lose faith.Remember "Faith is the substance of things hoped 4,d evidence of things not seen".God's ways are not our ways neither are his tots our tots.

Hi liveurlife glad all is well and U submitted your RFE. At least you know your case is being looked into. Am good holding on it s 13 months no RFE just 3 prima facie about to renew it for the 4th one next week. Hopefully I don't get a 4th just approval. I called my congress person and they told me to come in so they can do an inquiry, the said it usually take up to 30 days for a response so I think am gonna go in if I get a 4th prima facie.

Hi All!

I'm new here and need some advice maybe, I been reading this forum for a while and you guys always give me hope. But I think I'm starting to lose it now. It will be a year on October 12th since I've submitted my VAWA petition. I was asked to send background checks and I did. On March 18th I received my Prime Facie determination and it expired on September 4th. I don't know how to deal with this uncertainty everyday of my life. I'm full time student and want to transfer to 4 year college for nursing, but there are so many legal and financial issues stopping me.

I guess I just want to know if I should contact them and ask about my case. Also can I renew my Prime Facie even if it expired (on September 4th)?

Any kind of advice and information is very appreciated!

Welcome saadat. Yes you can renew your prima facie. Do you have a lawyer?

You can also contact them in regards to your case status. And you can receive financial aid and scholarship with your prima facie for your education. Goodluck!
