How can anyone get people in those positions (safe for the priest, maybe) to write an affidavit? I feel ackward asking even good friends; who has the time?

If they love you and care about you they will write the affidavits, even lie to help the VAWA case. You would not feel awkward if you were desperate like many of these VAWA filers.

Real abused victims will have plenty of affidavits from credible witnesses. Then the importance of other "real" evidence is important, too.

sarah kan make sure you will include "everything" they need to approve your Vawa case this time, for sure something was missing and you couldn't prove that you were battered and/or a bonafide marriage. Do you have someone representing you? make sure if the same person will represent you again he/she does not just send everything all over again without adding and/or changing something in your case, otherwise you will get the same result. Are you in removal proceedings?

If I was aware of anything I would not married person like that! And yes is my problem. But ppl come to this forum to share there experiences and situations not to tell one to another its your problem. Saying something like that will not make you good attorney and you should watch what you say (or write, in this case) or change profession!

I totally agree like if he/she had nothing good to say just be quiet and keep it moving. We are here to help each other not judge. Good luck with everything.

I forgot to mention that I also attached my official marriage certificate and official divorce decree.

Hello everyone,

My journey self petition begins today.

I have just mailed out all my applications:

- I-360 forms

- personal statement

- letter from my psychologist after seeing her weekly for 2.5 months

- 200 photos on different occasion from the time we just met..including her families and mine

- letter from my divorce lawyer

- 2 letters from my landlord and roomate stating that my wife barged into our house and threatened me

- her SSN and Driver license as a proof of her citizenship. She was born in my country and get netrulized here in US. I explained in my letter why I couldn't get her passport or her birth certificate. The reason was we placed our important documents inside the safe lock. We both have keys to it. When I got home, she took all her documents out and even my I-20 for my student visa as well.

I hope that's enough for a proof of citizenship

- police clearance report

- certificate from Red Cross for volunteering 100 hours.

- a photo showing the big mark on my neck. She bite me till my neck was bleeding.. I didn't call the police..dang it

- a photo showing she pinched my belly really hard..it left scars

- bank statements shown my name and hers. She knew I need to proof a good faith marriage. So she doesn't want to open anything under our names.

What's my next step?

Ps: I applied I-360 alone

When she ask for the expedite her court case was for next week but her lawyer sent a letter to the judge last week cause she didn't get a decision on her case so he got the judge to postporn the date and they gave her July 2013. Wat do u think.

Vawa- Vawa based on mental abuse you need to specify how you reacted the abuse, how you changed after the abuse, how the abuse affected you in that moment.They need to know the emotional consequences of the abuse, and not just your statement about the abuse.Despite your psychologist sent an evaluation , you need to tell them how you felt and/or reacted every time you were abused by your spouse.

Did you ask in your cover letter for USCIS to search in their records about her status in this Country, if you didn't ask they won't search and you will get an RFE to provide copy of her birth certificate or passport.

lorphelp me they still can expedite her Vawa based in her last information, but if the adjudicator wants to perform his/her job well he/she will check in the computer about her Court date and they will find out her Court date was postpone until next year, then the chance to have her case expedited is no great right now.

Sandranj if you know any lawyer who is expert in VAWA cases in new york and NJ.please tell me about him/her.I will be very thank full.
