newimmigJD in cases of Vawa based in "mental abuse" psychological evaluation has A HUGE weight. A good psychological evaluation can make a great deal of difference in Vawa cases. I have two cases of two women that filed Vawa based in mental abuse, they had just their testimony and the psychological evaluation. They were so controlled by their husbands they didn't have ONE SINGLE bill in their names, not even bank account, no one single document to prove bonafide marriage and mental abuse, but the psychologists performed a great evaluation and stated to USCIS those women were mentally battered, they were controlled, suffered all kind the humiliations, they were harassed, humiliated,degraded,verbally abused, lived in fear.The psychologists could demonstrated the abusers used power and control to abuse them and USCIS approved their case with just their testimony and psychological evaluation.

Regarding affidavits from friends and family they are highly trained to "smell" lies,lol. Yes it's better to send affidavits from independent witnesses.

Macbook it's mandatory to prove if your wife is a US Citizen or LPR, they can't approve your case without knowing her status ok. If you do not submit a copy of her passport or birth certificate they will deny your case!!!!!.

Do you have copy of her passport? if you don't have then pay for some web site to search her birth certificate. Do you know where she was born, which city?.

The Department of Health and Mental Hygiene can provide a birth certificate copy for someone born in their State oR check with your State "Department of health".Did you submit some pictures with her to some of your family members or friends? ask them to forward the pictures. If you had bill in your name or in name of both you can get all bills calling or emailing the bank, cable tv, cell phone company etc...

Hello everyone,

My journey self petition begins today.

I have just mailed out all my applications:

- I-360 forms

- personal statement

- letter from my psychologist after seeing her weekly for 2.5 months

- 200 photos on different occasion from the time we just met..including her families and mine

- letter from my divorce lawyer

- 2 letters from my landlord and roomate stating that my wife barged into our house and threatened me

- her SSN and Driver license as a proof of her citizenship. She was born in my country and get netrulized here in US. I explained in my letter why I couldn't get her passport or her birth certificate. The reason was we placed our important documents inside the safe lock. We both have keys to it. When I got home, she took all her documents out and even my I-20 for my student visa as well.

I hope that's enough for a proof of citizenship

- police clearance report

- certificate from Red Cross for volunteering 100 hours.

- a photo showing the big mark on my neck. She bite me till my neck was bleeding.. I didn't call the police..dang it

- a photo showing she pinched my belly really hard..it left scars

- bank statements shown my name and hers. She knew I need to proof a good faith marriage. So she doesn't want to open anything under our names.

What's my next step?

Ps: I applied I-360 alone

That's just crazy and lying I think.

It does sound like they are asking for an awful lot of stuff. Some things you don't have like those pictures, other evidence...that is your problem for not being more aware of documentation during your time together.

Ten affidavits? How good are the affidavits for credibility, professional, verifiable, and consistent?

If I was aware of anything I would not married person like that! And yes is my problem. But ppl come to this forum to share there experiences and situations not to tell one to another its your problem. Saying something like that will not make you good attorney and you should watch what you say (or write, in this case) or change profession!

I had many affidavits. From federal agent, attorney, doctor's, professors, priest all people with credibility. Also I have approved I-130 and they have on file her birth certificate, but they where too lazy to look in my file. I'll go tomorrow to county building and get what I can get and I'll call few companies to see if I can get copy. Thanks for all your help!

Sara khan "deny" it means "refuse to grant", if you got a letter saying your case was denied it means your case wasn't approved by Immigration. Did you get a denial letter?

There are some attorneys who have scruples and limits. It is not all about he money. Many pro bono attorneys too who believe in the individual clients.

I think what sandranj says really happens and many VAWA claimants are total frauds who just want to live in the USA for selfish financial reasons etc.

The fact that a person can totally lie, go to a psychologist and fake his or her complaints, get a report turned in to USCIS with little or no evidence to support and get an approval is unfair mainly to the US Citizen sponsor who gets taken for a ride, burned, cheated, humiliated, hurt whatever. It also paves the way for more cheaters to attempt to come to the USA.

Also, for the real abuse victims it puts them at risk of denials and hurts them.

So, for real Vawa like I said, get credible reports, go for pscy eval HONESTLY, collect the evidence, call the cops for real abuse, find a caring attorney, be faithful, trust in the truth/justice/God, and hope for the best.

For the liars and fraudsters and con artists and such some will make out like bandits and make the VSC "specialists" look like a bunch of clowns while hurting many people along the way. Shame shame. VAWA should be extremely hard in my opinion. It looks like the statistics are improving a little in favor of more denials. I work hard for my money and pay a lot of taxes. I don't really want to support a bunch of cunning cheats from another country when there are plenty of good US Citizens who are more deserving of a little help. Seriously, send more fakes and phonies back to their mud huts in their home countries.

Ha ha, maybe voting Republican is a good idea this year.

I just got RFE letter. They are asking for following: Certificate of Marriage (Certified from county clerk). My spouses proof of US citizenship, and proof of Bona Fide marriage, this is second time that they are asking for it.

I don't know where to get my wife's Birth Certificate? Also all pictures she has, all bills what where in our names she has. I don't know what to do. Last year I send about ten affidavits and all proof that I could find but they are asking for more?

I knew it!!! they will ask you again about proof of Bona Fide marriage I told you that, when I read your post I was 100 sure you failed to overturn the decision, right now you are in the hot zone, kind of they just wanted evidences not cheap talk (Affidavits from Friends or family), but dont worry I know exactly what they want from you and I can guaranty you I can help overturn the situation, but for that I will like to ask you some few question tho!!!

1- where your wife was born!?

2- do you have a ID or DL valid?!

4- do you have your approved I130 with you!?

3- do you have your certificate of marriage (original)!?

well, give me some answers and I will show the right way to overturn that RFE, but keep in mind the clock is ticking and you got only 87 days, every second counts.

How can anyone get people in those positions (safe for the priest, maybe) to write an affidavit? I feel ackward asking even good friends; who has the time?
