resignedtoinswhim Vawa Unit is adjudicating the cases filed in May,2011 then you can wait a little bit and if in 60 days they don't adjudicate your case then you can ask your congress person to help you out or if you prefer you can ask your congress person to help you now,it won't hurt your case tho. You can write telling that you are considering to file a writ of mandamus, but I don't advice to file the writ of mandamus less than 16 months waiting the approval.

Hi Sandra, does that also mean they are also looking at RFE cases or just cases filed on or before May 2011. I filed in April 2011 and turned RFE some weeks ago. Thanks

Hey Loveme, Bossy and others in the VisaJourney family...

Sorry I had been out of the loop lately. My greencard interview went well. The officer was nice...although i felt that she was a bit skeptic. But toward the end she said that my case is approvable and i should get the card in 3-4 weeks. I finally got a call from my attorney today that they received my greencard........yeah!

My journey ended after 2 years....all the torture, trauma...sadness, fear....and then the journey of VAWA with uncertainities, patience, waiting period...ended!!!

I can breathe now.....!! I feel refreshed. I feel that God has given me a second chance. Now I'll try my best to make the most out of this second chance.....God bless everyone.

And for all of you that are waiting, please be patient....the journey is tormenting...but there is light at the end of the tunnel!

Feb 21st - receipt notice received

Feb 27th - prima facie received

March 18th - letter for biometrics appointment for April 15th

April 15th - biometrics appointment done

May 15th - EAD approved

May 20th - received EAD card

Sept 23rd - RFE received

Dec 14th - RFE response send

Feb 17th 2012 - filed for EAD renewal

Feb 23rd - received an email from USCIS: I360 APPROVED!!!

Feb 23rd - transferred my case to NBC

Feb 24th - receipt notice for EAD renewal

March 7th - RFE issued for EAD

March 13th - RFE response send

March 29th - EAD renewal approved

April 10th - received EAD card

SandraNJ...My filing date is in July 2011 and I have been waiting over 14 months. No RFE. I contacted USCIS recently to renew my PFD and asked about case status. They promptly responded they are currently processing applications on or before May 7th 2011 and reissued my PFD. Would contacting congressman would be advisable in my case and would it be helpful?

What about 'writ of mandamus'? Should I write to VSC that I am thinking of filing for 'writ of mandamus' or should I wait and for how long? After writing the intent to file 'writ of mandamus' to VSC, how long should I wait to actually file one in case I don't receive a response from them or again receive a response that they haven't reached application of July 2011 yet?

I have the same filling date as u, yesterday i sent a letter to my congressman for help. I have not herad anything from vsc for 14months now, they just keep on sending me pfd. I will keep everybody updated as soon as i hear something from vsc.

September 22nd 2007 - filed I30, I485 and I765

November 15th 2007 - receipt notice received

December 17th 2007 - 1-765 APPROVED & Card received a week later

May 5th 2008 - Interview

August 10th 2010 second interview, i had moved out of our apartment. My Husband got the notice.

November 2010 order Deported in absentia, same time i was homeless.

Jan. 5th - Went to family place and heard about vawa.

July 18th - filed 1-360

July 26th - Receipt, prima facie received. ICE looking for me.

August 12th - Went to see Ice and they gave me a deportation officer, she let me go after i showed her my prima facie and told me

to report to her in october . i should be approved by then.

Jan. 24th--- PRIMA FACIE RENEWAL FOR 180 days

July 25th --prima facie Renewal for 60days

STILL WAITING ! NO RFE TILL DATE.

Sorry I had been out of the loop lately. My greencard interview went well. The officer was nice...although i felt that she was a bit skeptic. But toward the end she said that my case is approvable and i should get the card in 3-4 weeks. I finally got a call from my attorney today that they received my greencard........yeah!

My journey ended after 2 years....all the torture, trauma...sadness, fear....and then the journey of VAWA with uncertainities, patience, waiting period...ended!!!

I can breathe now.....!! I feel refreshed. I feel that God has given me a second chance. Now I'll try my best to make the most out of this second chance.....God bless everyone.

optimisticchic they use to touch Vawa cases twice, first time to issue a prima facie and another time to adjudicate the case, but sometimes some cases are missing documents, or it wasn't filed properly or they need more proof/evidence then they issue RFE to request what they need to adjudicate the case. They are adjudicating May 2011, but of course there are some cases in the middle from April as well.

hi sandranj: do you know any VSC staff, please help me a little bit, my case is on Jan 22th 2011, now still under initial review on March 28th 2011, although VSC sent me RFE on Sep 7th 2011 and Notice of Action on June 28th 2012, they said they will adjudicate my case in 14 days after they received my reply letter, which I sent to them on July 20th 2012 and my past three years non-criminal record and two US citizen reference letters on Augest 6th 2012, so far still no result, maybe just as somebody said the quota of i-131 is used up, need wait for new quota next month. I am not sure.

the thing is I got new job for one clothes company here as sale manager, I am in charge of our company's sale branch in LA, shall I go back the state based on that working visa or what? also I need frequently go to international clothes exhibition, such as Paris or Italy clothes exhibitions, if i got my green card this year, can I go out the state and come back without any visa or I-131 travel documents?

my boss knew my situation, who tries to help me with more money to let me pay for my wife's drug rehab and my Seattle house mortgage, my job need always do business with Europeans or American companies, everyone need clothes in this world, it is really tired, but money is good, plus i can bring my wife to visit Japan, Paris,Italy, UK, let her see the world. last year our company sold $16 million dollars, the business is booming. anyway, working hard and pay more taxes in the state, got more taxes return too.thanks

Young Seattle there is no quota for I-131.If you have a work visa and you don't have a ban to enter in USA you may enter, but keep in mind because you have a pending case with USCIS probably the Immigration officers won't let you enter using a work visa.

Keep in mind too if you overstayed in the USA then you have a bar of 3 or 10 years to reenter, to overcome the ban you will need a waiver of inadmissibility which requires showing that denial of admission would cause extreme hardship to your wife. Anyone who accumulates 6 months to a year of “unlawful presence” in the U.S. and then departs triggers a three-year bar, if overstayed more than one year triggers a 10 year bar.

Once you have a green card you can travel abroad and reenter using the green card. You won't need advance parole or visa.The GC will be the document to reenter in the United States.

You should can VawA unit to inquire about your case. You already waited 14 days then you can call them. Good luck.

According to May 2012 Vermont Service Center VAWA Unit Stakeholder Call from June 2012 additional resources have been added and you can see the numbers starts to creep up.

Also alot of petioners have responded to RFE's which eventually increased number of pending cases. But the bottom line is; they are getting more new application each month than they complete which is affecting waiting timeline. They just released "Processing Time" today to 15 months as of end of July 2012. I would expect it to go higher :crying: until they catch up with new petition compared to completed.

I know, I know, it sucks to wait but numbers don't lie. Calling your senators, congressman, VSC hotline etc to speed up the process will make things worse for everybody. I think we have to appreciate the fact that Prima Facie is issued immediately, and if you send your petition together with I-485 you will be eligible to get work authorization while your petition is pending. I know we have all been through a lot, but will it hurt to "hold our horses" few more months?
