Hi guys:

The more i did my research on VAWA, the more I feel confused, now VSC's intake process center is processing my I-131, based on VSC's timeline on Augest 17th 2012, they are now processing I-131 on March 12 2012, my one is on March 16th 2012.

But how about my I-360? VSC sent me "Notice of Action" letter on July 14th 2012 for my I-131, who required me hand in all my VAWA evidences again. So I guess they did my I-131 and I-360 at the same time, my last I-360 review date is on March 28th 2011.

Since I already sent my letter to VSC to ask for my I-360 result last month by following Liveurlife's suggestion, who got i-360 approved after VSC received this kind of request letter with signature. But I didnot get any result yet except this " Notice of Action" letter.

The other funny thing is WSP wrote down this on my past three years US non-criminal record, they said my citizenship is USA.

So by any chance if I got my I-131 and I-360 approved, I need apply my EAD to work in Seattle and wait for another 6 months to get my greencard interview, right?

I am really really tired after 19 months waiting, although i tried my best, find my state governonr and two senators for help, maybe the only reason is I cannot afford $8000 to hire NY attorney for my case defense.Only God knows when is the end of this journey.

And my wife is drug addicted who smoking crack, we never see each other for 19 months although we are still married for 3.3 yrs, all i can do is email her and comfort her, also sent my two younger sister-in-laws some small gifts and movie DVDs by mails, I totally sent 12 mails to VSC and 10 mails to my wife and my two younger sister-in-laws. Life goes like this for 19 months already! Does US immigration really really have to go this kind of hardest way!?

lorhelpme the USCIS web site states:

What is the process for expediting cases for T, U and VAWA applicants? What criteria are used to determine if a case will be expedited? How long are adjudications taking for expedited cases for T, U and VAWA applicants?

Customers should call the VSC VAWA Hotline (1-802-527-4888)

http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=5a870c100c475210VgnVCM100000082ca60aRCRD&vgnextchannel=68439c7755cb9010VgnVCM10000045f3d6a1RCRD

Tell her to try both phone.

I have read that before but it's says bases on extreme humanitarian grounds I don't see anything about expedite or removals. But thanks will tell her to call

Hi lorphelpme:

i first applied my I-131 advanced parole based on extreme humanitarian on July 10th 2011, I said my wife is serious drug addicted who need my help, although I paid $360 for my I-131, which has been denied by Chief Elizabeth from DHS in washington DC, who said based on Secretary of state rules, my case is an individual case, with no benefit to general public, that is why I remailed it to VSC supervisor, who granted me fee waiver for my I-131, which is what I am waiting for right now.

Congrats Palmbeach. Were you able to expedite your I-360? If yes, for what reason? would appreciate if you can share this with us.

Hi ,i did try to expedited my I360 but i didnt qualify for it, in reality i try to transfer the priority date from my approved I130 to my I360, but they reply saying that i didnt qualify because only people that will wait for visa number and have an I130 approved can transfer priori date. So my I360 was approved without expedite. I m waiting now on my interview.

Good luck everyone.

Good luck singledad2usc. Knowledge is power and power can save your life. With my little evidence, i just hope ad pray for the best cz at times less is more. :-)

Congrats Palmbeach, now a sigh of relief is all u can embrace :-)

Thanks , hope we all get done with the wait for interview and those waiting for approval of I360 get approved soon too.

Hi lorphelpme:

your question is the same with my pastor, but who said if I abandoned my wife, then she died.

Sorry to hear there, but i think you are a bit mess up... I360 are for peoples that are abused... Did she ever abuse you or herself??? You will need to prove a abuse, that she abuse you... At this moment you are the more important person for USCIS, cause you are the victm and you need to prove that she abuse you, not herself...

myjay talk with you lawyer how about if he emails USCIS and say that he is willing to file a writ of mandamus because your case is taking forever,I bet USCIS will run with your case.I did several times. Writ of Mandamus is a judicial remedy, when USCIS is taking FOREVER to adjudicate one case (more than 18 months) we ask an order from the federal court to obligate the USCIS to adjudicate a petition in a timely manner. As I said DO NOT email USCIS saying you are willing to file a lawsuit if your case is less than 18 months.D on't worry they won't get mad at you because you are saying you are considering to file a writ of mandamus, but they don't want to deal with a lawsuit because some employee is sitting with your case there and usually they run to adjudicate.

Thanks sandranj, i will mention this when I speak with my lawyer.

youngseatle I don't want to ruin your parade, but to have your Vawa approved you need a miracle, and I believe in miracle tho. The Vawa wasn't created for cases like yours. You plan to have a life with the alleged abuser.USCIS accepts form I-360 when the couple are living together because the person is afraid to leave, the person fear for HER/HIS life, but USCIS is convinced the individual will move out of the house and leave the abuser as soon he/she get the Vawa approved. I don't think is your case. As I said if you have your case approved you can tell God operated a miracle in your life.

USCIS won't expedite your case based in the alleged abuser needs. USCIS will adjudicate your case based in the abuse you suffered, that's all.

Hi, guys, im new on this forum. hopefully somebody can answer my question. i filed VAWA december 2011, and still no news or RFEs. well, i thought we filed i-485 and i-765 concurrently so started getting worried and asking my lawyer about my work permit only to find out that both i-485 and i-765 were temporarily rejected back in january because there wasn't an immigrant visa available immediately, and now we have to wait for i-360 approval and then send those again (thats what my lawyer told me). i did have an i-130 approved back in 2005 i think but had to wait to adjust my status since my husband is an LPR and not a citizen, my priority date became current a couple years ago but i never got to file an adjustment since he abused me and i left him. so now im wondering what am i supposed to do, just wait for vawa approval and then file i-765 and i-485 or can i try to sent them in right now again with the letter asking to recapture my priority date from an approved I-130? thank you very much for your advice
