Vawa I didn't understand why your lawyer decided to wait the prima facie to send your I-485.I mean you have two options or to file I-360 along with I-485 (not advised) or to send the I-485 when the I-360 is approved.Is unusual to wait the "prima facie" determination in order to submit the I-485, it doesn't make sense for me at all.

Feb 18th 2011 - filed I360, I485 and I765

Feb 21st - receipt notice received

Feb 27th - prima facie received

March 18th - letter for biometrics appointment for April 15th

April 15th - biometrics appointment done

May 15th - EAD approved

May 20th - received EAD card

Sept 23rd - RFE received

Dec 14th - RFE response send

Feb 17th 2012 - filed for EAD renewal

Feb 23rd - received an email from USCIS: I360 APPROVED!!!

Thank you for letting me know loveme. I got an email notice last week that my case was transferred to another office and that I'll receive a mail stating the exact explanation. I'm waiting to get that mail so that I know the exact details....

So you suggest that I should wait for I-360 to be approved first right?

I can't afford to pay 1000$ and not even sure if I could work or not.

I always thought that when we send in I-485 and I-765, we can get EAD after 3 months even though I-360 is still pending . So this Is incorrect, right?

I hired my lawyer because he charges only 800 for the whole process

And plus m applying via emotional abuse which is hard to get approve :(

Vawa you can get work permit if you have the I-485 pending You can ask to waive the Uscis fee for your work permit.I just didnt understand why your lawyer is waiting the prima facie to submit the I-485.He could sent I-360 and I-485 together or wait the I-360 approval. I am not sugesting you to wait the I-360 approval. But you need to keep in mind one thing if you send the I-485 and your vawa is denied they will start with the removal proceedings but if you don't have a I-485 pending and your vawa is denied they are not deporting. It's up to you.

Hello All,

Could someone please help me with an issue?? I got the letter USCIS sent me requesting initial evidence for my EAD . My Problem is my rep is on vacation for two weeks and she's booked after that untill first week of August and I really don't want to wail till then to send the initial evidence. All they're asking for are copies of my I-94 and a copy of my driver's license for identification purposes. Can I send these document to them on my own or do I have to wait for my rep. Please help!!! I'm in the process of looking for a job and I'll really need this EAD ASAP.

You can send the documents yourself. Don't need to wait for your rep.

on the other hand, I need money to survive.

If i get a prima facie, what kind of benefit can I obtain?

If I-360 pending and I-485 is pending, would the EAD be issued?

If you are F-1 you can seek employment at school where you are attending. Without pending I-485 or approved I-360 you can not get EAD. Just submit I-485 with fee waiver and then you will be able to get EAD.

Well I don't know what is going to happened. Write them letter saying that you had $800 and that you payed your attorney with it and that you don't have any money. (My advice is to tell the truth and nothing else).

Regarding VAWA based on emotional abuse. Yes that is VERY hard to prove but if it happened then you should not have a problem!

I agree with you 100%. USCIS collecting fees and taxes should have more staff and run more efficiently.
