Wat happened at the interview. I know a couple people who's spouse never showed up but did the interview with a lawyer told the io that things didn't work out between them and spouse and the still ended up getting the green card but it was for the 10 yr green card. If you said you did experience abuse and know u have a strong case then do what's best for u.

U need to try to be on top of things cause they just might put u in removal proceedings.

My lawyer asked the IO not to put me on removal proceedings since we will file for VAWA within 60 days. Now, my questions are:

1. Would it really be best if I will hire the lawyer again for this procedure?

2. I would need to consult a psychologist regarding my stressful and depressed state. But I moved to another state after the no-show interview. So I will seek psychological help where I am now, right?

3. I will file for divorce already. WIll this help my case?

4. Are there any husbands there who went through my case? Any help would be greatly appreciated.

Choiskoph I advise you to hire a lawyer in your case,to prove mental abuse is not easy at all. You can find some pro bono lawyer to help you with that.

Yes, you should seek psychological help now and after a few therapy sessions (3,4) then ask the psychologist a mental health record. It doesn't help at all applying for divorce now, because it's not mandatory a divorce decree to file Vawa.

Get in your home Country your police certificate and in USA as well, it's to show "good moral character".

did the immigration officer ask you to send proof that you filed the Vawa? if he said that it means he won't start with removal proceedings.

Hey Macbook, there's a VAWA hotline #:18025274888(not the regular USCIS # cos they won't give u any info there on vawa cases) which only attorneys/representative can call & also applicants that don't have attorneys on file-i don't know how fast they respond to individuals though. What i know for sure is that whenever my attorney calls that #,sm1 always gets bk to her within 72hrs-aweek with some news...they sent me a prima facie one time after she called to check on my case...it was not requested in writing & the last time she called, they said to wait a little, that they are almost there,i'm still waiting n the wait is killing me.My attorney said they have been very slow in VSC though as regards to all the cases she filed with them. They will only respond to cases that are out of processing times though on the vawa hotline, according to their timelines.I'm in the 14months & 2weeks mark right now.I hope to hear something soon but anyhow, will have to holla @ my attorney again to make a call to the vawa hotline 1st week of july. This is becoming ridiculous as their processing times keep changing everyday.

choiskoph get the police certificate in all cities you lived in the USA since you got here. It's very weird the USCIS officer asked for your lawyer to send a formal communication that you are filling the Vawa, every single case I handled the adjudicators gave 30 days to send them proof that the Vawa WAS FILED , not a formal communication. Start right now some therapy/counseling because without some report of your mental/psychological abuse it will be almost impossible to have your Vawa approved.Get some notarized affidavits from friends and family stating the abused you suffered. Write your own affidavit(7/10 pages)mentioning since you met her, fell in love, got married, tell about her controlling and jealousy behavior. Explain in details every time she humiliated, harassed and threatened you. Good luck.

choiskoph go to the police station to get the police certificate. It's to show good moral character.

Thank you for the input. That is what I am going to do now. WIll I need the police report from my home country? I guess a lawyer will really be of help in this case, don't you think?

With regard to the psych evaluation, do I need to see a professional counselor, a psychologist or a clinical psychiatrist?

Choiskoph If someone can send you a police certificate from your home Country it helps a lot. Well to prove mental abuse is not that easy, if you can afford to hire a lawyer I advise to hire one or try to get a pro bono lawyer in your area.If you see a psychologist is better. I recommend you go for at least a few therapy sessions and the psychologist will evaluate your mental health and will give a report stating if you have some depression or are suffering for anxiety or if she believes you suffered mental abuse.
