lloydgc your lawyer did the rational and correct thing sending just the I-360.In case your I-360 is denied the USCIS won't deport you, they are holding deportations for I-360 denied, but if you submit everything together and the I-360 is denied the USCIS will start with the removal proceedings. You don't have I-485 pending then you won't be able to get EAD,just after I-360 approval ok.

it is exactly what my lawyer explained me but at this point i'm not worried that much about if the i 360 gets denied. i know and pray it will get approved, and even in the event it doesn't get approved, i would prefer to fight it in front of the judge for cancellation of removal, than staying left out here and not be put in removal so i can do that. my wife actually went too far. she divorced me by forging the documents, and i was never served but somehow the documents where notarized and signed by her attorney,.. incredible USA.. she has been forging my checks to cash and nothing i could do. and the thing is she obtained the divorce after we were separated but she tried to keep a relationship and for two years until i went myself to file for divorce,.. isn't that the piece of cake? i am currently not working, ckearly inactive and that is the reason i'm wondering why i shouldn't just apply for i 485.

Excuse me Sandranj,.. or any other, what do you suggest i do about my correspondance from uscis that i am not receiving?

my head is about to explode some time soon, help please.

Am really confuse as to wat you are saying abt you and your wife.are u with her.

me and my wife are still married, she never say divorce, I have no rights to abandon her, VAWA doesnot say you must divorce to apply, I have psychology test, doctors try to put me into mental hospital, I just feel depressed, not that serious, eat some brain recovery medicine, I donot want to put it in my SSN, otherwise I cannot find jobs later on. I just donot have experience on how to deal with drug people, I hate drug dealers, hope they are all elimintated by God's mighty power. now you understand me.

I have been waiting for 13 months no changes at all, no RFE, nothing... Its so frustrating...

I guess there is hope..

the same thing happened to me, I know exactly what you are talking about, since i never received my RFE from VSC, i kept calling USCIS hotline, their staff tried to explain to me that my case is too sensitive, they have no authority to read what is on my RFE letter, even now my case update date is still on March 28th 2011, no touch, no nothing, all i can get from USCIS hotline staff is good luck on your I-360, sure this is a hard way to get my legal status in the state.

But i have no choice, my wife is scared on those lawyers and judges after I billed her out for her first DUI charge in 2009. I tried to find one lady attorney in New York, she want to charge me $8000 just re-drafted my self-petition letter. I wrote letter to VSC supervisor, with this $8000, i can let my wife go to rehab for twice.

VSC in their stakeholders newsletter said they will try to finish 50% all their pending cases this June and July, I told my wife probably I can go back Seattle soon, it seems like things are getting slow again! I never been to Vermont state, if i have chance to go back the state, sure i will go there to worship them!(nothing offence) at least show my appreciation. only God knows when is the end of this journey. keep reading bible at home.

do you ever eat this medicine, CITALOPRAM HBR 20 MG, my anti-depression drug from Seattle sounder mental health doctors, at the begining, everything is ok, later on, i got more depressed, maybe only relief is after my VAWA approved.

I am in Florida. I am not an expert on VAWA, i hope someone else here can help you. Try not to worry too much and stay healthy, all will be well soon trust in the Lord :)

Anyways my interview was on May 30th here in NYC - 26 Federal Plaza.My appointment time was for 10:30am and of courseNYCbeing NYC the subway was delayed!!!! Thank God I left on time and reached there at 9:45am. My lawyermeet me there at 10:22am.We were then sent to another room that specifically deal with VAWA and Refugee cases. By the time we checked in and they took my appointment notice it was 11:00am. My lawyer and I went over my case and he reassured me that I had a VERY strong case and that I had nothing to worry about (LOVE HIM !!!).

At 11:20am I was called in for my interview. The Interviewing Officer was the NICEST person ever. First off he already determined that he was going to approve me from the way he was steering the conversation. He actually apologized to me for all that my husband did to me. He made me feel at ease and was cracking jokes :)!!! He then asked me some yes / no questions from the I-485, NO questions about my husband, our marriage or the abuse. After that he took my EAD saying that I will never need that again - that I was trading up for something much better!!!! Then on June 6 th I started to receive alerts for my Green Card status

June 6th - email - we have registered this customer's new permanent resident status (EXCITING!!!)

June 11th - email - we have ordered the production of your new card (EXCITING!!!!)

June 12th - email - we have mailed your new card directly to you (EXCITING!!!)

June 12th - email - USPS reported that they picked up mail from USPS containing your new card ( EXCITING!!! )

June 14th - email - USPS reported that your new card was delivered!!!!!!!!!!!! (SUPER EXCITING)!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

The immigration officer did advise me though to get a divorce as soon as possible.

To all that are going through this process may it be that you just filed, waiting on an approval, waiting on a reply for a RFE or waiting for an interview date - PLEASE hang in there. I was there just a few months ago, I know how hard the waitis because you think everyone else is getting through and that your case is being forgetten - believe me I have been there, through every emotion possible known to man.This forum is great because you realise that you arenot alone in your journey to be FREE and have a life apart from your abuser.

I have all of you in my prayers and I look forward to hearing about your interview stories!!!

Did anyone else realize that uscis updated the processing times for i360 but the one for vawa was entirely REMOVED isn't that just WEIRD. Hopefully when they do put it back in there is a drastic change to the timeline

Llydgc+go+to+your+lawyer+office+and+ask+him+the+original+prima+facie+determination+and+he+can+keep+the+copy+in+your+file.+STOP+emailing+Uscis+regardin+the+receipts!+You+need+just+the+prima+facie+determination+the+receipt+is+not+a+big+deal.+USCIS+takes+30+to+45+days+to+set+up+your+biometric.+YOU+can+call+Uscis+and+ask+to+speak+with+a+Tier+2,+do+not+call+them+more+than+once+and+ask+him+to+open+a+request+for+you+and+wait!++Your+lawyer+still+have+time+to+send+your+I-485+the+problem+is+that+Uscis+is+messy+and+no+guarantees+they+will+put+your+I-485+together+with+the+I-360+BUT+your+lawyer+can+try+or+set+up+an+appt+with+infopass+and+figure+it+out+with+them+how+you+can+file+the+I-485+at+this+point.+Stop+sending+letters+or+emails+to+Uscis.I+read+you+emailed+them+11+times.+FORGET+ABOUT+THE+RECEIPT.+You+won't+have+the+Ead+approved+now+because+you+don't+have+a+I-485+pending+and+you+will+need+to+have+the+I-360+approved+to+get+the+Ead+in+your+case.I+don't+even+know+why+your+lawyer+filed+the+I-765.
