hi all, and thanks for sharing so many vital life experiences on here. don't know if this means much but i have just checked processing time on i 360 and it's back to being 5 months,.. which is really cool, if they respect that.. that means approvals coming for those still in the wating room,.. good luck all and stay positive.

btw i have a question,.. there is a say by my friends attorney that he can obtain ead while his vawa case is still pending. under eligibility code c 31. is anyone familiar to that?

unfortunately the answer is no... C31 is not the right code for Vawa pending...

if your case is still pending the best way to file for EAD...

It file I485 + EAD and use C9 as code that will simple, correct and you may be eligible..

now if your case Vawa is approved you can use C31 code (only if your application has been approved)

if your case Vawa is approved under deferred action use C14 as code...

hey guys, i read somewhere that an immigration judge can adjust your status , is this true?? I don't remember where i read it...

well It depends on the case and how your lawyer handle that..

but keep in mind you got to file first the I485 with USCIS and the Judge will review...

but that is not your case...

in your case like you said your lawyer already file for Motion to TRP..

that means... It will take between 3weeks to 3months to the judge to overcome /close the case

and allow you to continue your case with USCIS...

you are in the right way and your lawyer is doing the good job.

why I say that cause you got your master in august 2012 and I guess you will get

your individuel hearing may be in juin 2013. that means you will receive your GC

in 2013 but your lawyer is doing the perfect job that will allow you to receive your

GC asap...

well Im still alive,still here,still waiting for my approval to come

and give me a opportunity to file

a motion to terminate removal proceedings with Immigration court.

in the same waiting for my EAD ugh!! that sucks!! (sad)...

I still have a long long way to go...

sad to say that but hope to hear from VSC soon 'cause

today will be my 78 days after I sent back the RFE...

but my instinct telling Im stocked because my case is still

with the Immg. court and they are waiting for that to make a decision...

God bless everyone waiting...

Dont think for a moment that you are bothering anyone. We are all here for each other in one form or another ok. Good as for ead you file for that when you do i485 you can't get it without filing i485 next thing I'm not sure what category it comes under when you have a pending VAWA . To any that's thinking about filing I know it's a risk but please file

File I485,i765,i360 together it saves you a lot of time . Risk risk risk and pray about it good luck.

Feb 18th 2011 - filed I360, I485 and I765

Feb 21st - receipt notice received

Feb 27th - prima facie received

March 18th - letter for biometrics appointment for April 15th

April 15th - biometrics appointment done

May 15th - EAD approved

May 20th - received EAD card

Sept 23rd - RFE received

Dec 14th - RFE response send

Feb 17th 2012 - filed for EAD renewal

Feb 23rd - received an email from USCIS: I360 APPROVED!!!

Feb 23rd - transferred my case to NBC

Feb 24th - receipt notice for EAD renewal

March 7th - RFE issued for EAD

March 13th - RFE response send

March 29th - EAD renewal approved

April 10th - received EAD card

New processing time on USCIS website for VAWA is 5 mo. I send my application one year ago and still don't have any disigion. Its driving me creasy. What should I do? :crying:

Call me cynical but I truly believe they posted that in error, specially with reauthorization still pending and VAWA as we know it in limbo in congress.

Only thing you can do is wait.

sidenote, I found myself being dangerously depressed taking risks on stuff I normally wouldn't and being completely apathetic about life. Not just about the abuse that took place but just with everything. It's to a point where thinking about my death actually cheers me up. like "hey, I'm going to die anyway..." I don't know, I'm just rambling on speaking my life anonymously on the internet. the only thing keeping me going right now is the thought of my younger brother being without his closest blood relative. otherwise, i doubt anyone would even notice if i died.

anyway, didn't mean to use vj as a journal.

i read your post StillAlive and i'm still wondering why they say c 31 is only for approved vawa but they say you can file it concurently in their instruction. are they gonna hold on to it until they approve the case? this really is my real question. cuz i 765 processing time is 3 months, so that will force them to make a decision an the case between the 3 months or how they gonna work that out,.. i'm confused.. my lawyer is asking me to proceed with c 31, and he is convince they will give it to me that way. i was wondering if someone else had that working for them before,..

well lets be honest here...

I was in the same situation like you last month (see my timeline)

I ran out of money and only way to overcome that problem... It is working

and for that I need a EAD. keep in mind my I360 Vawa is still pending

since March 2011, I did some homework over and over and finaly I got a conclusion

to file I485+EAD in the same time of course using category C9

why I did it because there is not Category for EAD base on pending Vawa...

trust me thats based on my own experience but you can try C14 cause its better than C31

like I said C31 is for approval Vawa not pending Vawa...once again Im not yet a Lawyer

but Its on the way...

well do what your Lawyer is asking you to do after all ... thats his job.

Hi everyone let me tell u what happens now..a few weeks ago I called a congressman office to ask for help in my case( I 360 pending since march 25,2011 not even prima facie) they told me USCIS would contact me soon( USCIS sent me a letter saying that my was been reviewed for final decision on march 26 2012) a few days ago call a congressman and they told me that USCIS sent me RFE on march 28. I check mailbox every single day, online and my account to see touch and Nothing... ??

My Lawyer had to call the court herself before they finally sent off my file to VSC, if she didn't call I'd still be waiting for the Court's clerk to do their job ! Ask your Lawyer to contact the Court and see whats up

I Doubt you gonna get EAD without an VAWA approval since the Courts still got jurisdiction over your case, well atleast thats what my lawyer told me
