Murid: On the 485 form, there is a question I am not sure how to answer. It is:

Have you ever applied for permanent resident status in the U.S.?

* Yes (If yes give date and place of filing and final disposition.)

* No

Since I have filed a 485 before and went to the interview to tell IO that I am filing a I360, I guess I should say Yes, but what did you put as the date and place as well as the disposition?

I intent to fill in with my old 485's receipt date and my local office's location. I will say pending for the disposition. Could you tell me how did you fill that question on your new form?

How long does it take to hear from uscis about the i765? I sent my last week and did even received a reciept yet...

I filed mine June 14 and received NOA on June 17

Also, Murid, did you withraw your old I485? Can I still request a fee waiver if my old I485 is not withdrawn but pending?

I dont think you should put pending. Because if you do so they might not accept the new one you filing since u have one pending. I never withdrawn my old I-485, it is still pending with USCIS. Once they close your I130 that will automatically close it.

I dont think you should put pending. Because if you do so they might not accept the new one you filing since u have one pending. I never withdrawn my old I-485, it is still pending with USCIS. Once they close your I130 that will automatically close it.

Hi Tuckahoe8, you and I seem to be in a similar situation. I did the interview with my spouse when we applied I130/I485. The I130 was approved, which my attorney will ask the IO to substitute with the I360 tomorrow. After applying for I360 in 2010, my attorney personally went to the local office and ask for my I485 to be put in abeyance, and not adjudicated until the I360 is approved. Can you hold your I485 application for just one more day. My attorney is meeting with the IO tomorrow 8/11/11 to request my file from VSC and to find out how they will proceed with the adjudication. My lawyer told me I do not have to do another medical. I have no problem sharing with you what will be said at the infopass. The lawyer told me that if I file a new I485 based on the approved I360 with a fee waive through VSC, it usually takes 5-6 months for approval.

Blessedwoman: I went through the same process alone at local office, to get my old I-485 approved based on approved I-360. I sent an email and a written request to VSC to send my file called T-FILE, to my local office for interview. VSC sent my T-FILE to my local office after month I went back to the local and i was informed that my old I-485 is with a supervisor and in order for them to schedule me for an interview I need to file a new I-485 with VSC. Luckily my medical was still valid I went to the doctor and got a sealed copy (No charge) and send it to them. I dont know about the wait time but based on previous post from people who used their old I-485 they waited longer than those who filed a new one. May be it varies by local office. Mine is Washington DC. Keep us posted about your new info. Best of luck

Blessedwomen: It seems that the only difference between us is that my I130 is never approved, my spouse never went to the interview with me. I went alone and told the officer that I am filing I360. The officer asked me to note that down on the interview sheet.

nov 04 Went to interview by myself, told officer will aplly for vawa

11/04 I485 touched (still on initial review)

11/21 officer called lawyer about the I485 (btw: really nice IO)

12/10 apply for VAWA, without background check

12/11 lawyer drop off a copy of I360 for the IO

12/15 Prima faice received

12/18 sent background check, also sent a letter to IO asking to expedite the I485 to vermont to be linked with I360

12/31 I360 touched

08/04 Apply for EAD renew

So today I went to my local office to get information about my Biometrics. So they told me that VSC has requested my biometrics but it has not being scheduled yet. But the lady was really nice and she said u know what i will schedule you for one right now. So earliest that she could do was 09/02/2011. But I will try and do early walk in on monday.
