HELP WITH SOCIAL SECURITY AND AOS.

Hello and good day to everyone!

My fiance is here with me now she arrived last June 8 and then we went to Social Security Administration June 9th and filed for her Social Security card.. we've been told to wait for 2 months for they will mail the card to us. (We are getting married on June 28th.)

Questions:

1. Can we start filing for AOS without a number? (Social Security Card)?

2. The card that will arrive in two months would have "Not Eligable For Work",. Right?

3. So we have to wait 2 months for the card and 3 months for AOS process, that would be 5 months all in all before she can start work?

Please, response are appreciated... Thank you so much.

You don't need to have the social security number for AOS, you can file it as soon as you have all the paperwork, including the marriage certificate, ready. The SS card will be stamped with something like, not eligible to work without DHS authorization, which would be the employment authorization card. It takes about 90 days after filing to receive the EAD and then she is good to go. Once the green card is received the EAD is no longer needed as the green card is authorization to work and also you can have a new social security card sent that does not have the not eligible..... on it.

Should have waited about three weeks for her info to circulate in the computers; then she could have received it in a week.

we've been told to wait for 2 months for they will mail the card to us.

NO, the SS card and the EAD/GC are two different entities. 5 months total with SS card coming within the first 2 months.

2. The card that will arrive in two months would have "Not Eligable For Work",. Right? YES, BUT IT USUALLY TAKES LESS THAN 2 WEEKS TO RECEIVE THE CARD.

3. So we have to wait 2 months for the card and 3 months for AOS process, that would be 5 months all in all before she can start work? NO, THE WAIT TIME FOR THE SS CARD & AOS IS CONCURRENT, NOT CONSECUTIVE

What's more, this forum is not the appropriate place for a K1 visa holder to post questions about Social Security numbers or adjustment of status. Please post your question once only, and in the appropriate forum. :innocent:

hi ridgid, i think you are in the wrong thread.... this is the ROC section.... you need AOS...

But to answer your questions, 1) yes you can apply for AOS without a SSN. 2) well i applied for my SSN card AFTER we did AOS and my card says "Valid for work only with DHS Authorization"... not too sure what yours will say, i assume the same. 3) thought they say it will take 2 months to get the card, you most likely will get it within 2 weeks. but you will then need to wait til you get the Work Authorization letter, and then you will be able to work. and yes, took me approx 5-6 months from time of starting AOS till when I was allowed to work.

The I-765 is optional, and it's free, yes, free of charge (as in $0.00) if submitted concurrently with the I-485.

That said, there is no need to file it and if there's no pressure to find a job as quickly as possible it there is no merit to even submit it other than having a cool ID card, issued by the federal government of the United States of America. Once the Green Card has been issued, the EAD becomes worthless.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . back to the OP about SSN

whoops - you didn't wait long enough for the K-1 visa holder to have a record in the SAVE database.

Wait 2 weeks from the POE date, go back to SSA office, apply again, ask for lookup in the SAVE database in both A# and VISA name,

then if they can't find it by either, do not let them have the application form, come back every 3 days until they can find it,

then apply.

Then come back next day, and GET the number - card should show up within 2 weeks.

So far, what you've done, is the KISS OF DEATH for getting a SSN, these validations are rarely done on time or even properly, and with her just one day in country, it will drag and drag on.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
