so..i,m marrying in novemeber in a cival ceremony...discovered the documentation i need for this..even though does state i need to bring my social security card??.but being english dont have one ..so not tooo sure about this?.....have discovered its the k-3 or cr-1 i need......and now i have discovered consular filing??...i,m really lost!!lol........it does mention obviously checking the particpating offices that will allow this...how would i actually find out about this.?will be marrying my us fiance in new jersey...also....would the consular filing include my daughter or would i have to apply separatley for this?.....there doesnt seem to be an awful lot of info on the consular....am i to assume yes this is the quickest way to move..but the most difficult??.......and does anybody know the acceptance rates??.......thanks again........x :help:

yes thats correct,thats the plan....what would the reason be for not being able to do dcf...??? many thanks..x

For DCF in the UK, he would have to have legal residence there.

You can't "DCF" in the U.S. ... there's no US consulates in the U.S. To immigrate to the U.S. based on your marriage, you will have to file for the CR1 and optionally the K-3.

It would be fraud to use the VWP or visit visa to enter the U.S. with the intention of staying permanently following the marriage.

I think you misunderstand something. DCF refers to a US citizen Filing an I-130 petition Directly with a US Consulate (or USCIS field office) abroad rather than with a USCIS Service Center in the USA. Since you reside in the UK, that would mean after marriage your husband would want to file his petition with the USCIS office in London. However, USCIS-London will not accept petitions for processing unless the petitioner is resident in the UK (I forget the proper term for the status).

Your fiance does not have the requisite status in the UK, and so cannot have his petition processed by DCF following your marriage.

I completely understand now........shame but hey worth a try i guess!.....so i,m thinking best to apply for the k-3 and the cr-1...and then see which ever progresses the quickest?.thankyou very much

Just to be sure that all the loose ends are tied up - the I-130 is a prerequisite for a family-based immigrant visa, in your case it will probably (hopefully) be a CR-1. Whether the I-130 is filed in the USA at a USCIS Service Center or overseas by DCF, the visa is the same - the only difference is how long it takes to get the visa starting from the time the petition is submitted.

hi yodrak.you,ve been really helpful thankyou.....would i not need the family based one though due to me having adaughter whom i obviously would want to bring across with me?and i have read amongst here that you can apply for the cr-1 and the k3..and then..continue with whichever is the quickest abandoning the other?? thanks again....
