1-130 approved! What to do now.

That's not correct, the provision in the LIFE Act that created the K3 was never repealed. The NVC had been receiving the I-130 and the I-129F filed in conjunction with the I-130 at the same time, in February 2010, they implemented a procedure where the I-129F would be administratively closed if it was received at the same time or after the I-130.

USCIS adjudicates petitions they receive, they do not "determine what type of visa is needed" because that is something the petitioner will already know.

If you are seeking a fiance(e) visa, you file the I-129F for K1.

If you are seeking a spousal visa, you file the I-130 IR-1/CR-1. Spousal visa seekers have the option of filing an I-129F in conjunction with an I-130. The filing of an I-129F in conjunction with an I-130 opens the door for a K3.

NVC policy is this: If they receive the I-130 at the same time or before the I-129F, the I-129F is administratively closed. If the I-129F is received before the I-130, it can go forward.

Hi everybody, me and my husbands I-130 with a notice day on march 6th was finally approved on june 13th. Thank you for all the valuable help so far! I have looked around trying to understand the NVC journey but have not understood really how to do. Ive understood that we are going to call to get a case number in a couple of weeks. But when we have that, then what? Do we have to wait to get something from NVC or can we start filing on our own? Would love some information of what to file and how to do it.
