My Fiancée has 2 children. But at this point in time it was agreed that they will stay with the father and family for at least a few more years. My question is should they still be listed on form DS-156K or not. Will that cause an issue in bringing them here in the future as a IR?

If they are unmarried and under 21, then YES they should be listed even if they are not travelling with her now. There is a provision on the form to indicate whether they will be accompanying/following her or not. If they are not listed now, it will pose problems down the line when you are eventually trying to bring them over.

Filing based on 3yrs/USC Spouse. 3 year residency anniversary is in August 2014. Filed immediately after the 90-day early filing mark (May 2014)

YES, they should be listed on all forms asking for this information.

Does the form ask to list all children or list only children that currently require a visa?

The form isnt asking if the children are coming ... they are asking if she has any.

Not listing the children is misrepresentation, you have to list them.

March 2010 - sent off I-129F

March 27 2010 - Vermont receives package :)

April 3 2010 - Informed through mail that cheque is cashed NOA1

May 28 2010 - RFE notification ( yeah Im online checking alot >.< )

June 5 2010 - RFE hardcopy received

June 18 2010 - RFE returned ( had done it June 7 - but USPS returned grrrr )

June 23 - Touched

Aug4 - Email notification of NoA2 :)

Aug. 10 - NOA2 Hardcopy received

Sept. 13 - Faxed off Package 3

Sept 14 - Interview notification set for Oct. 5

March 17 2011 POE Canadian/US border

April 1 2011 Marriage

Mailed AOS June 1

Chicago Lockbox confirms delivery June 3

I got here in 2007 and my USC hubby petitioned my 2 kids in the Philippines with no problem.List all children even if they will be coming here later.

she will need to list all of them and bring there birth certificate and a copy of each also i think the follow rule is up to a year cutoff and also if they come now the adjustment of status will cost less for you if it is done with the mother :thumbs:

Thank you everyone for your replies. I do now understand the importance of the term “disclosure” as stated by some, and what the repercussions no matter how innocent it may seem to us or how unimportant it is to us at the moment, that it will be a big problem either immediately or somewhere down the road. Again, thanks for your input and for sure they will be listed on the DS156K. Rick
