Received the RFE....

Hi everyone

So the RFE came through the post today, it is asking for more evidence for the I-864....roshon has never filed a tax return as he has never had a job (just on scholarship from college) but they are asking for it??!! I wrote a letter when I filed for AOS stating that he had never worked and that he was on a scholarship so therefore had never filed a tax return...any suggestions on what we should do? We are going to ask his school to write a letter about this, do u think this will work?

They've also asked the same thing for our co-sponsor...everything we have already sent with the original package so I'll just send another copy of that.

all you can do really is send documentary evidence of his complete lack of income, and I guess statements of his scholarship payments. And resend the information from your co-sponsor. And more if they can scrounge some up. Did you send letter of employment, pay stubs, tax returns etc etc etc?

Did you still send an I-864 from him? Even without an income & with a co-sponsor he still needs to submit one.

What I did was to submit form 4506-T Request for Transcrip of Tax Return to the IRS. They sent me back a letter that states no tax return was submitted for the year(s) in question. It takes maybe 6 weeks to receive their response. Also re-send what was sent for Co-Sponsor. Hope this helps.

well we've spoke to his school and they are putting together a letter about his scholarship and how much he gets and that is is non taxable, hopefully this'll help.

Gonna ask the co-sponsor for a new letter from employer (we used old one from K1) and some more paystubs, hopefully this will work (and resend all tax and W2 info).

We did send a I-864 for Roshon....with a letter explaining about tax returns but hey I guess they feel like a second letter
