Hello everyone!

I'm new here. I've read a lot of comments about visiting fiance while K1 pending... but my question is... I have a valid B1/B2 visa and would like to go to the States to spend the holidays there with my boyfriend. We don't know if we should file K1 before December or in December when I'm there... He's coming to meet my family in September and we were thinking about starting the visa journey then....

Has anyone traveled there this year with a K1 pending? If yes, can you please tell me details about what to say at POE? I know... always tell the truth, but I'm looking for examples here...

You bring ties to your home, you tell the POE that you are visiting your fiance(e) and you have a K-1 petition in process. Show them the NOA1 if you have it. The NOA1 greatly helps your chances.

If you have not started the process it will be harder, telling them you are going to see your fiance(e) without good, strong enough ties to home they will likely stop you.

Your interview took 67 days from your I-129F NOA1 date.

I visited two months or so ago, while my K1 was pending, had absolutely no issues at POE (SFO in my case) at all, only after stamping my passport did the CBP officer ask where I would be staying and made some comments about the long visa process.

Same here, My fiance visited me twice during the process. He was honest and upfront at the POE and produced a return ticket to show his intent to return. Never had a problem. Good luck with your visa journey! :)

I visited while K1 pending. He applied for me in April 2010, and I visited in August 2010. While I was visiting, we got our NoA2 :)

I brought alot of evidence with me to POE. Morgage, house bills to show current, a letter from my employer showing my return date to work, court order showing children split time with their dad and when I was expected to recieve the children back, emails with my ex showing our communication verifying dates, return plane ticket and travel insurance showing the start and end dates.

The customs guard didnt inquire about the K1, but I had visited alot the year before, and I told him one was applied for. He asked if I worked, I said yes, and he asked to see a return plane ticket which I showed him.

I was overly prepared and had very strong ties to Canada. A pending K1 didnt interfere with my POE at all.

Many people have visited from Canada and the UK while the petition is pending. There is always the chance that you can be turned back by CBP, but the crucial thing is not to try to hide the fact that youa re visiting your fiance. That can get you in to all kinds of trouble. Just bring the evidence as other people have listed and you will be good. :thumbs:

I just returned from a 6 week trip to the US...

Entered at newark, said I was staying for 6 weeks and the guy didn't even ask why, or to see a return ticket

I also went for three weeks in march, all I was asked was if I was visiting friends.

I brought "evidence" both times but never needed it. Better to be safe than sorry I guess.

His POE was Newark. He did say he was going to visit me (his fiance). He said the officer he had was really nice and was joking around with him. Didn't ask for any details or questions about K-1 or anything like that. They did take him aside to a secondary screening room - but they do this every time he enters the US, even before we were engaged. We don't know why - I think because he is young and travels alone. They just asked him about his job and how much he earns and when he was returning. He had lots of proof (letter from employer, all our K-1 docs, his rental contract) but they didn't ask to see anything. Just grilled him a bit and let him go through.
