Isn't the VJ website full of tolerant intelligent people? instead of helping her with her case, you all spend time blasting her for her choice in who she wants to be with or marry. Its not for anyone to judge, its her decision Its better to help her and everyone else on this forum and keep negative opinions to yourself.

There was a case here in florida a few years back. there was a man who was in jail for molesting and killing a little girl. After time in prison he had parole. At his parole he stated that he had found god and was no longer a threat to anyone...within a few months of being out..He sexually abuse a little girl then buried her alive......Yes maybe..and i use that word sparingly ..there are people who can curve their activity.....but most cases sexual predators will do again. I know people want to give hope...but fact is I would never allow my daughter around a man that was accused of any sexual wrong doing~

If you have children....and someone sexually or abused them maybe even killing them would you think one mistake was forgivable?

Yeah, one example shows you how everyone will behave...

I personally know more than a dozen convicted sex offenders who have gone over 20 years without re-offense. I even know one man who was 16 when he was convicted of molesting an 8 year old cousin almost 30 years ago. He never hid it. In his divorce he got custody of his 2 daughters (both very young) and spent 10 years raising them as a single parent before re-marrying.

If someone wants to change they can change anything, it just takes a true desire to make the change. I'm proud to call this man my friend...

People are so in the dark about sex crimes that they really shouldn't even speak until they do a little research (from all angles of the issues).

Why is it that over 90% of convictions are First Time Offenders.

Why are there people on the SO Registry for Public Urination, Skinny Dipping, Unlawful Restraint (no sexual aspect to the incident), 17/18 year old sexual encounter with 16/17 year old boy/girlfriend?

I'm not Christian but I'll remind all of you of something from the bible, "Judge not lest ye be judged".

With the SO witch hunt it's a scary thing to be alone with even your own minor children these days. Vindictive ex-wives & girlfriends have used false claims to gain the upper hand in divorce & custody cases. The laws are written so that even if you card all of your sexual partners and one of them falsely identified as of legal age but was in fact 17 your life can be ruined as there is no defense once the "victim's" age has been proven. The only way to be sure you're never accused is to just die at birth.

Do any of you really think you're helping the OP here by berating a man she knows and personally cares about when you have no knowledge whatsoever of him or his situation?

Hi all,

I heard tier 1 sex offender can be reduced in 10 years if during this time they aren't convicted any other sex crimes. Is it true? This is 10 years since my fiance has registered of sex offender. During this time, my fiance hasn't been convicted any other sex crimes. I think my fiance can ask the court to remove him out of sex offender but not sure if it can work. If it happens, our case might be more positive? Please advise me?

The Jacob Wetterling act, says that after 10 years if no trouble you should be removed from the registry , but you have to petition the court and ask them/show evidence you havent been in trouble

http://www.registeredsexoffenders.net/Jacob_Wetterling_Act.html

"(6) Length of registrationA person required to register under subsection (a)(1) of this section shall continue to comply with this section, except during ensuing periods of incarceration, until??

(A) 10 years have elapsed since the person was released from prison or placed on parole, supervised release, or probation; or

(B) for the life of that person if that person??

(i) has 1 or more prior convictions for an offense described in subsection (a)(1)(A) of this section; or

(ii) has been convicted of an aggravated offense described in subsection (a)(1)(A) of this section; or

(iii) has been determined to be a sexually violent predator pursuant to subsection (a)(2) of this section.

(7) Registration of out?of?State offenders, Federal offenders, persons sentenced by courts martial, and offenders crossing State borders"

The problem is most states have adopted the adam walsh act, which will ex post facto and give him more time. If his state has not adopted the adam walsh act, he should rush to a good lawyer and try to get himself removed.

Its probably going to be impossible though unless he is rich, because they love to keep people on the registry forever regardless of what they are on their for.

What if he moved to your country and lived, or you guys left together to another country and started a life? Its not as crazy as it sounds . You shouldn't have to do it, but think of the lawyer cost money , that could be used for a home/land/life

good luck! Let me know the outcome

Wow. Loved the Picture

Hello.

Yes, ACLU challenges Adam Waksh Act for the number of provisions, but the prosess is slow by all means and there is no results yet. I would try to contact them, just to see what they will say. How? Google should help find contact info.

We were denied due to AWA as well. We reaplied. We are married - you are not, but I don't see the principal difference why you could not reaply as well.

Dont forget the froof of completion of the therapy!!!!! That is your #1 document!!!!!

Yes, letters from ex family, employer, your relatives will help too! With AWA there not such thing as "unimportant" document. Anything which hints on his positive character helps. Pictures of you happy together - not that much, but why not to add them too?

Does he volunteer anywhere? On the interview we were asked that too.

Appeal is pointless.

Find a lawyer to handle your proof of him not being a threat to you!!!

Good luck.

Hi there,

Thank you for your email

My fiance has talked with the lawyer and he advised to resubmit k1 visa. However we should wait 3 months until appeal period then we can resubmit again. This time we will hire a lawyer so he can help to handle the proof of him not being thread to me. We were denied becase of lacking councelling document. Now i understand this is number 1 important. Would you mind telling me why your case were denied?

P/S. It's helpfu if you guys can give us good advices. I know my choice and he's best choice. Don't adjust someone if you just base on the criminal background. A GREAT MAN DOESN'T MEAN THAT HE'S NO RISK. I found many great men who ARE so sick in Mind. I never want to judge someone who is bad or good until you're around him and contact him enough long to conclude thiS. Again, I'm so sorry if i didnt explain enough about my case and my fiance. But DONOT JUDGE about my man ! This is my husband and I donot want you guys to think badly of him. He derseves to be respected like normaly everyone !

Just a note here. I hope he's NOT your husband because you're doing a K1 petition. You want to be VERY careful about referring to him as your husband when he's not because people have been denied because the CO thought they were married when they weren't simply because they called each other husband/wife in emails, and sometimes the traditional ceremonies (as someone else mentioned at the start). Remember, he's your FIANCE, not husband.. yet :D

i have removed the picture posted previously by the op to protect the identity of that individual - posting a picture of an individual and identifying him or her in the manner used in this thread may not be the wisest thing to do.

Hello All,

My case has been denied due to Adam walsh Act. The 2 main reasons are that my fiance didn't provide the proof of 3 years of counselling and 2nd is that his D.U.I.We have submited all the evidences to prove my fiance doesn't posk risk to me, However, my fiance didn't submit 3 years of counselling as it was a part of his sentence. He was convicted of possession child porn 10 years ago. He aslo submited the evidences of alcohol treatment..I dont undestand why they still deny us? What should i do now ? Should we appeal now? Please show me how to contact with human rights group and ACLU? I'm so panic and deeply sad. i love my fiance till death. Please anyone there help us? Please Please Please

I would steer clear of this guy. Your chance of immigrating to the U.S. with him is slim to none as things stands now. Deliberate hiding or falsification of a material fact is material misrepresentation and will bar you from the U.S. for life if you're a part of it.
