North Carolina to require some employers to check citizenship

RALEIGH, North Carolina (Reuters) – North Carolina lawmakers on Saturday passed a bill requiring businesses with 25 or more employees to check the citizenship status of job applicants on a federal database called E-Verify.

After a 24-month phase-in period, the legislation will require about 40 percent of the state's businesses to verify the immigration status of potential hires.

E-Verify compares information from an applicant to Department of Homeland Security and Social Security Administration data to confirm employment eligibility.

The measure passed the House in a 67-45 vote after undergoing changes in the Senate.

The final bill disappointed its chief sponsor, Republican Representative George Cleveland of Jacksonville. He wanted the requirement applied to all businesses regardless of size.

The bill now headed to Governor Beverly Perdue's desk also provides an exemption for agriculture companies that employ people such as crop pickers for 90 days or less.

Cleveland said the measure won't cover many undocumented immigrants working in the state.

"The people that we really should be looking at are not covered at all because most illegal aliens in the state are not being hired by big corporations," Cleveland told Reuters.

He said he proposed the bill to help citizens looking for jobs in North Carolina, where unemployment is higher than the national average.

"We have some 280,000 illegal aliens in this state and we've got 9.7 percent unemployment," he said. "Of course I'm looking for jobs for the people of this state."

State Representative Harry Warren, a Republican from Salisbury who co-sponsored the bill, said, "The version that got passed is not exactly what we hoped to have, but it's a step in the right direction that puts us in league with similar measures in 13 other states."

William Gheen, president of Americans for Legal Immigration, an immigration enforcement advocacy group, welcomed the bill. But he said he was disappointed some Republicans tried to "completely gut the bill to protect the jobs of illegal aliens and those that hire them."

Several states have enacted immigration restrictions, even though the U.S. government considers it to be a federal issue.

Last week, Representative Lamar Smith, a Texas Republican, introduced a bill that would require most of the country's employers to electronically verify the immigration status of potential employees.

I wonder if this will cover "seasonal workers aka pickers"?

Good idea...on the right track. It will be interesting to see who opposes using this and why they want to continue exploiting people for $$$.

However,it will not work until the penalty,or reward, for using legal labor exceeds the risk of using illegals. Passing a law is one thing, destroying the business of people that exploit humans for profit is another.

Given what it costs US taxpayers for the actions of these employers for their own profit, I would not be opposed to an $8000 tax credit for every legal worker employed (worked to sell houses)OR a complete tax exemption for any business that can verify ALL its employees are legal. The current tax code is a very powerful tool for social change and seems to get used often for that, but when it comes to the problem of human exploitation for profit...everyone forgets how it works. :wacko:

E-verify is a method to verify the legal employment ability of a potential worker. It is a tool. Requiring a carpenter to use nails and hammer would rule out the better screws and cordless driver method to accomplish the same thing. Requiring a business to use a particular tool to comply with existing laws seems kind of silly. In fact, it is simply another hoop to jumpo through for employers making the employment of illegals more attractive (and easy) On the other hand, IF we are to have strict penalties or valuable rewards, we MUST have a tool to make it easy for employers to comply. E-verify is a good one for that. We should also do away with the I-9 procedure if we are going to go this route. Layering BS on employers to accomplish the same thing does nothing to help legal workers.

The PENALTY for employing illegals or the reward for NOT employing them simply must be increased.

When we make it a "no-brainer" to use LEGAL employees, then ALL the other problems of illegal immigration will vanish.

Still wishy-washy. Most companies employing illegals are small. The roiofer that picks up 4 workers at Home Depot in the morning for example. Small employers are much more likely to exploit humans to save $$$. They are also much more malleable to tax code penalties or benefits.

Obama and his slave traders will attack any state that tries to eliminate human exploitation for profit but wouldn't you like to see him come out and say a state can't tax businesses within the state? :lol: If North Carolina introduced a $10,000 per worker TAX on illegals, is Obama going to say "North Carolina can't do that!" ??? If North Carolina says "Verify all your workers are legal and your business will be exempt form ALL forms of state tax, including workman's comp." is Obama going to say they can't do that?

I would actually LOVE to see them make that argument. :lol:

So it is political pap. Typical. Politicians have no intention of doing anything to end slavery. They pander to their conservative or liberal constituentcies. The liberals will loudly "oppose" this law in an effort to show their "support" of the slaves, but will do nothing to end the human exploitation, which they all benefit from.

Ya, I didn't think it would include seasonal workers but I didn't read that part. I can see though were this law is going to have a few loopholes here and there, but it's a start in the right direction imo. I think this is only the beginning of such laws in many states. Give it a few years to be polished up and I think it's going to have an effect on illegal immigration. Now if they can only do away with the anchor baby's and like gary pointed out...give these company's tax credits for doing the right thing.
