Second NVC RFE...

My wife is going through the Lima embassy, and did not submit a court record because she does not have one...

According to NVC's own site:

"If you were convicted of a crime, you must obtain a certified copy of each court record and prison record, regardless of the fact that you may have subsequently been granted amnesty, a pardon or other act of clemency.

Court records should include:

Complete information about the circumstances of the crime

The disposition of the case, including sentence, fines or other penalties impose"

She was not convicted of a crime, and her police records which we did submit reflect that fact.

The RFE is stating that we must submit the judicial records if she is over 18, but that doesn't jive with the info they provide on their own site. Am I missing something?

What they say, goes! It may not be fair, but neither is life. Give them what they are asking for and unite with ur wife. In everybit of my research, I've been instructed to send a police record along with the application. Criminal history or not. It is just something that cost more money. But is it worth it to be with my honey, Yes! Good luck!

Hey Shan, thanks for responding. Actually, we did submit the police certificate with a notarized translation, that is not the problem. They are asking for the court records (which don't exist because she's never been charged with a crime) even though their website explicitly states that they are not required. I don't understand why they are asking for a record which does not exist, especially if they claim they don't require it UNLESS the immigrant has committed a crime.

Okay,

Your wife is not a criminal; however, she should submit 2 documents more: 1. Certificado de antecedentes Judiciales a Nivel Nacional y 2. Certificado Judicial de Antecedentes Penales. They will both say " NO REGISTRA" if she has no criminal record. You need to look further....to the US embassy/ LIMA website. The requirements are there. Hey El Cachalote, thanks for the response, you're right on the money. I stayed up all night to talk to NVC at 7:30 est and they explained to me exactly what you just said. Do you happen to know if we need to translate those documents as well? I don't see that it says we do from the link you provided.

Hey,

If you are going to the US embassy in Lima, then NO TRANSLATION IS NEEDED!!!!! Original Spanish/Castellano is adequate. I am certain of this.
