GUYS please, please clarify this...

Here is the thing, PEOPLE SAY THAT YOU MUST PROVIDE LAST YEARs TAX RETURN STATEMENT with AN AFFIDAVIT SUPPORT...

I didn't file any taxes last year, but i just got a good paid job, i start this monday, and i will get paid 2000-3000$ a month, its 24000-36000$ a year. which is above the minimum poverty guidelines requirements. IF I INCLUDE THE LETTER FROM MY EMPLOYER STATING THAT I WILL HAVE A FULL TIME JOB NOW AND IF I INLUDE 1-2 pay stubs will it work??? I NEED TO KNOW FOR SURE. Cause it's kind of hard for me to find a Co-sponsor, i have no family in USA, that's why:(

OR Because i didn't work before and didn't file the TAX RETURN i need to find a co-sponsor?

THANK YOU,

Murad Minasyan

If you didn't pay taxes last year because you legally did not have to, you could make a statement explaining this. However, I would contact the consulate you will be going through and ask about it to see what they require of you. Each consulate is different.

Did you not work at all last year... e.g. received absolutely no income or savings interest, etc.?

Tax Returns (and supporting documents) or Tax Transcripts:

Most folks include their most recent year's - some consulates/embassies request them (some do not). Since you don't have it regardless - you can't provide one. You can provide an explanation as to why you did not have to file (and hence, why you don't have one). Did you work/file taxes the year before last? Were you a student? What's your history (say over the last couple of years)?

Co-sponsor/no co-sponsor

Whether you should get one (or not) doesn't necessarily depend on if you did/didn't file taxes last year. It is mostly dependent on your current income (or perhaps length of current income/employment) and your history as well.

How long will you have been on-the-job by the time your interview comes up?

Sorry guys, just checked out the replies...

Here is the situation, i worked part time, and i'm a student, and last year i made 10000$, which is not a lot, therefore i need to find a sponsor...

I gave my W-2 form to my uncle, he is an accountant, so he can file it for me, and since i'm "dependent" on him/his wife, i gave it to him, and he included it to his profit/taxes income.

Do i need to take his all previous tax returns to show that i filed it or the explanation that i gave my W-2 form to him would be fine? OR I JUST SHOULD INCLUDE W-2 form with my pay stubs and the letter from the employer?

Other than that, I'm starting the job on monday, ill get paid 3000$ a month, which is more than enough regarding the 2011 poverty guidelines for a person who lives by himself alone, and who would sponsor his own fiance. And I will probably receive an interview date with all other documents on MONDAY as well.. so what should i do? i should wait till i get at least paid 1-2 times, get pa stubs, get the letter from the employer stating that i will be working for his compony and that he will pay me this much.

One more question.. to secure myself i want my aunt to be a sponsor for me. IF Her income is above the poverty guidelines, and I'm one of the "dependent" persons in the last year tax returns, even THOUGH I DO NOT LIVE IN HER HOUSEHOLD AM i considered a member of her household? IN OTHER WORDS... WHAT IF MY AUNT IS GOINg to SPONSOR ME, SHE LIVES WITH HER HUSBAND, BUt SHE HAS 5 dependent people, IN THE POVERtY GUIDELINE WHERE DO I LOOK? FOR 125% for 3 people (AUNT, husband, and my fiance) or 6 PEOPLE (5 dependents (Including me and husband) + 1 fiance)

I answered your question and you keep bringing it up. If you were below proverty level 125% last year, but you got a good job this year. You can just bring a letter of employment and current pay stab.

All right! Thank you very much!!1

Also some sources in internet say that when you fill out I-134 form you look at the 100% poverty guidelines, where on another hand when you fill out I-864 form (for adjustment status) you need to look at 125% poverty level..

Which one is right? If it would be 100% it would be great.

I believe that is correct but id rather do 125% on both cases, just in case the consulate is picky. I mean think about it, why would you approve someone who is making a, let say 115% poverty level at the initial, but the AOS requires a 125%.

Most consulates will go by the outlines and requirements of the I-864. You should always be prepared to show at least the 125% guideline minimum.

If you do not live with her, you are not part of her household. It would be your aunt, her husband and any other dependents of hers. Then to that total, add your fiance. You still have to fill out your own I-134, provide your documents, and then your aunt fills out her own separate I-134 and provides her documents.

Thank you guys...

Is both petitioner and beneficiary notified when k1 is a approved?

Guys I received second Notice of action which says that my K-1 application has been approved.

Who is going to receive other documents? MY FIANCE OR MYSELF (THE PETITIONER)?

It's very important because my fiance lives with my family, not in the address indicated above?

In some places i read that the beneficiary is going to get all the documents that she is going to fill out and go to the interview, in other places i heard that I WILL RECIEVE ALL THE DOCUMENTS INCLUDING I-134 form, and will need to send it to my fiance where she will need to make an appointment for a medical exam and go to the inteview.

How does it work?

Please clarify.

Thank youuu very much guys, sorry for bothering

WHAT if my fiance live in another place now? she moved... should i call and tell the she changed the address so she will receive whatever she needs to?

All right guys, that's what I'm going to do..

Even though i didn't make a lot of money last year,

I'm starting a new good job this monday,

it will pay me 600$ a week,

which is $2400 a month, and $28800 a year, much more than a poverty guidelines requirements.

I'm going fill I-134 form myself, include 1-2 pay stubs from the new job, and the letter from my employer.

Also, to insure myself im going to ask my friend to fill out I-134 form himself and since he is self-employed, he will include just 2010 tax return, and the copy of his Naturalization form.

He lives with his wife and his child.

The only thing is that my friend made 24,172$, which is when we look at 100% he qualified, but when we look at 125% he doesn't. BUT IT's just to insure myself...

What do you think guys? I'm very nervous and inpatient:( can't wait till my fiance comes.
