I was never married. She was never married. She is only slightly younger than I am.

It has been a burden on my fiancee and I. She cries every single time I talk to her over the phone. All she wanted is to be with me. Worst case, I will have to live in Vietnam.

I just wish the consulate charge higher fee for immigrant VISA and use that fee to search for fraud after the couples live in America. Harsh punishment for fraud if caught after living in the US.

is this a realistic option? i think you need a good talking with your fiancee. prolonged crying doesn't help anything, tell her to suck it up and deal with the reality at hand. worst case just get her pregnant, do the CRBA and they're home (USA) free :)

i'm still confused about the student visa explanation. obviously the CO believed if she got the student visa she'd just hide out with her relatives or they pull some shenanigans so she could stay permanently...and after she got denied you just conveniently showed up right after :bonk:

It's b/c of these red flags, and that is how we are in AP. I notice a few members live in Vietnam b/c after VISA rejection.

1st email, May 19, 2009

1st visit, first face to face, June 17, 2009

2nd visit, December 24, 2009

3rd visit, engaged in Vietnam, June 6, 2010

Filed K-1, June 17, 2010

4th visit,December 26, 2010

INTERVIEWED May 21, 2011 --> RE: Additional documents

5th visit, both of us went in to submit additional documents on June 16, 2011---> Result AP.

6th visit, I went to the Consulate on December 28, 2011

Got back to the US and asked Congressman for help.

March 10, Asked Senators for help.

March 27, 2012 DoS status indicated an expedite on my case after Senators inquiry

End of March, Phone call from Consulate at 11:30PM.

April 13 (or so) received letter asked to update medical and police report

Received VISA April 28, 2012

Very sad that you are in AP. This is only a hurdle and only that. Most people in AP come out of it with a pink. It is very rare to get a denial. I know this is easy for me to say but you both need to not be crushed by this and persevere. It is tough and understand she cries but get over it and fight this. One can't cry and fight. Be ready for anything and get your Congressman on it right away. Right now I am hearing defeat and you both are far from defeated.

I'm fighting it. I just emailed my Congressman and then will make an appointment with his office.

Good. Make sure to also bug the consulate often. I won't say everyday but often. Continue to keep saving any evidence like you have so far to show that you both are staying committed. I will say a special prayer for y'all. We are all here for you and ever need to ask anything of chat let us know.

well right now the CO might not believe this is a legit relationship. if there's a baby then the case would look different to the CO (imo).

This is very bad advice. Some of us have been here for a long time and trust me if they feel that this is not a legit visa try they will deny even if a baby comes along. The most in that case that can happen is that the baby will become a citizen and sponsor the mother when an adult. This consulate has in the past denied visas totally even with a baby involved. To them fraud is fraud.

Agreed. It's a common assumption in many countries that having a child clinches a fiancee or spousal visa, especially in countries that are somewhat conservative about sex outside of marriage. There are many girls in Vietnam with children that are now several years old after having tried and failed to get a visa. If it was that easy then every fraudster would happily get pregnant in order to get a visa. I've never seen a case where it helped, and I've seen several where it slowed things down.

I called my congressman office (Jim McDermott)and spoke to a Lady. She asked me about my situation and I told her everything about my case and the status. She told me that based on the status of my case, there is nothing they can do to help since the AP stated that they need time for additional processing and that we have to give time for them to process. Also, congressman doesn't me personally, so they can't write a letter.

She told me that if my case is denied or it has been more than the time frame for processing stated by the US Consulate in HCM, then they can help push that.

I told her that if I'm going to get the denial, then it is too late to get the congressman involve.

I don't know how else Congressman can help me at this point. Should I approach the Congressman office in a different way?

Any advice is appreciated.

give it a few weeks and ask the congressional rep to do a status check on the case for you... its common for them to check the status of the case for a USC.. mine checked for me monthly.. they have no impact other than it is documented each time they inquire...
