Kids interview for CR2

Hi, my wife received her CR-1 visa back in February, 2011 and she arrived on March 3rd. My wife also has 2 kids ages 5 and 8. We decided together it would be good for her to come by herself for a few months to get acclimated to life here in the US, learn how to drive etc. So the kids stayed with her parents while she was here.

We put in for the kids Visa's. Since we didn't know when the interview would get scheduled we booked a flight for my wife to go back to Philippines. She left on June 10th and will return to the US on June 30th.

Here is the issue. Immigration scheduled the interview for July 8th a month after we booked her ticket and my wife will be here in the US. The expense to change the ticket is quite large and plus we have a get together with my family starting on July 8th for a week which my wife would miss.

Our plan is to have my wifes Aunt take the kids for their interview. The lawyer assured me the kids interview is just a formality and my wife doesn't need to be present for the interview.

Will immigration be ok with this? Is there a possibility they could refuse the kids visas' if she is not there?

Also what documents do i need to bring?

I think we need the following:

kids Passports

kids birth certificates

photos for the visas

Any help would be much appreciated !

You can check out travelstate.gov for info in neither parents are accompanying the kids to the interview and also the DSWD website for info on children travelling with someone else.

11/05/10 – Called USCIS for Biometrics

11/22/10 – Called USCIS Biometrics Service Request

11/23/10 – Wrote & Mail Letter to Congresswoman

12/06/10 – Received Biometrics Letter after 5 months…FINALLY!!!

12/14/10 – Biometrics Done!!

12/15/10 - Card Production Ordered - Online Status-YEHEYY!!!:))

12/28/10 - Received EAD Card!!! Yahoo!! :))

12/30/10 - Applied for SSN

01/03/11 - Received SSN

01/06/11 - Received Interview Letter!! Yahoo!! Feb. 8 it is!!

01/08/11 - Interview Approved!Green Card Stamped on Passport!!

01/14/11 - Approval Notice I-130 & Welcome Letter!

01/18/11 - Received Green Card in the mail..
