Hi, Im pretty sure this has been asked before but I can't seem to find it so bear with me. We are due to ROC next year (Nov. 2012) and I know that it has to be done at a certain time. We have plenty of proof of co-mingling of assets but Im not sure if I will be working next year. My husband is the beneficiary. Im in school and will graduate in May 2012. Do we use an affidavit of support and if so, what if we don't meet the poverty requirements? My husband is working and we will have the fee to file. We were interviewed during the AOS stage, is it possible that we will be interview again for ROC?

Thanks for the help.

Tee

No.

Go look at the guides. There is NO support for ROC.

ROC has a 50/50 chance of interview.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

Hi Tee,

To answer your questions..... NO affidavit of support is required for ROC..... and MAYBE for the interview - there is a possibility that you will get requested for an interview, but majority of people DO NOT. There is no way in telling who or why people get chosen for interviews. (Please note, those applying for the ROC Waiver - divorce or death of USC - will be requested for interview).

From now till next year, just keep up with the "joint" stuff - make sure you get things like joint health insurance, lease agreements, car insurance, life insurance, bank accounts, etc. Also, if you will not be working but rather in school, make sure you put the USC spouse's name as the "emergency contact" for your school, and have your school print you out a confirmation of this... ive seen this included on the evidence list for other folks going through ROC.

Hope this helps!

We may get another interview and I will be prepared for that we have a 16 yr age difference!

It seems looking at all the filer's monthly lists on this forum that a very small percentage get an interview. I see RFE's a lot on the timelines but I wouldn't stress overly about an interview. Just personally I would rather interview than RFE. I think a lot can be conveyed in person and bonafides have no cause for concern.
