My husband had his interview and I need some direction. He was not denied they need more evidence that I don't support my 18 yr old son. He lives with his father and i have never paid child support for him. It was in our agreemnt that I keep the three girls, he pays for child support and 100% for everything they need, clothing, school supplies, medical insurance and activities fees etc.

We sent the total divorce package but maybe it overwhelmed them to try to find the details even though I highligted areas....??

Please tell me if im sending enough info for the consulate to verify that my son does not live with me nor do i support him.

Attorney letter verifying that I dont live with my son and he does not get any money from me.

Bank letter stating that I have never paid any child support for my son

His Drivers License showing his address

his bank statement showing his address

my lease agreement showing who lives with me (we had to list the girls individually on the lease per their guidelines)

letter from apt stating the only ppl living here is me and the three girls

two pages from the parenting agreement (instead of the packet) showing precisley what the attorney outlines in his letter.

Anything else would be greatly appreciated!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

His visa was not denied but he is in AP of course... we knew that would be part of it...they said send this info and we will try to see what we can do. he asked specifically if he was denied and they said noooo we just need more evidence about the son.

help me please anyone?

yeah it was i made over 500 but and included 401k assets worth ove 108k and showing it is not job related so can be cashed out at anytime. The issue was the 4 children...the 3 girls live with me and their father pays child support and all other exp for alllll the minors such as school supplies clothing medical and other unexpected fees including the firs two yrs of college...allll this at 100% and even stipulates this in the court papers. It does not say that i owe child support or anything for that area its clear....the father pays the mother xxx for child support PERIOD.

sorry thats 500over poverty line for me three girls and husband

Sure hope this can all figured out and hope you hear something soon. The child support is a tricky one in high fraud countries. They can either accept it or deny it as I heard in Casablanca. I had a court order and documents with a year's worth of direct deposit into my account from my ex's job. I know there are other who have showed proof with just checks and were okay. Stay strong and just give them all the information they ask for.

i will :( my attorny is going to outline that i waived my rights to my son and help outline the child support better. I think it may have been better to just give the two pages they needed to read but im so glad i sent evthing bcos they thought my assets were job related but my husband showed them it was from qdro n showed them the paper i know that helped with that....they kept his passport n said to send those in so we can issue visa....so im working hard to get it done asap.... Is that any good sign btw??

read page 7 top left and top right.... http://www.uscis.gov.../i-864instr.pdf

it states that if a child is not 21 but has reached majority in the state/domicile where it is considered majority age and not claimed on taxes then they do not count on household... my sonis 18 and considered majority in NC and he doesnt even live with me and i have not claimed him on taxes at all so that shouldnt be an issue

then on the top right it clearly states that if we use child support it can be included as income as long as we have supporting documents.

did i read this correctly??

Salam I am sorry about your situation, But insha Allah it will be alright, can you please tell us which slip he received Green/blue & secondly the documents they have asked do provide them soonest , Rest Insha Allah it will be alright. I have been put on AP on 26th May and still waiting. Insha Allah this is last hurdle we have in our processes,

They gave him a white paper i think that said:

This Office regrets to inform you that it is unable to issue a visa to you because you have been found ineglible to receive visa under the following section of the immigration and nationality Act. the information contained in the paragraphs marked with X pertain to ur visa application . please disregard the unmarked paragraph

(x) Section 221 g which prohibits the issuance of a visa to anyone whose application does not comply with the provision of the immigration and nationality act or regulations issued pursuant thereto.The following remarks apply in ur case:

Your Petitioner most recent income is not sufficient to sponsor you. A joint Sponsor is needed Please sent us an orignal signed affadavit of support i864 from a qulaifing JOINT SPONSOR along with all the supporting documents from the most recent tax year:

that said... they were counting my 18 yr old son into my household even tho i dont claim him on my taxes and he doesnt live with me and ive never paid child support for him. It was all in the parenting agreement so they said i didnt make enough money to support 6 ppl which is very true but i dont support 6 i support 5. He has reached majority age in our domicile and per the i 864 instructions it states that if they are under 21 and unmarried but reached majority age in the domicile that you live and he isnt claimed on taxes he is not considered part of the household. It's on page 7 of the instructions.

so they said for us to provide proof that my son is not part of my houshold and doesnt live with us and i dont claim him on taxes. I am sending the following evidence as proof that we are following the guidelines

Letter from attorney summarizing the child arrangement and child support payments and the fact i dont pay anything and that my 401k is not job related but instead a settlement from the divorce and that i can cash it out at anytime leaving me with cash for about 76k in cash without undue harm as i was not intending to use this as a living maintenance but as a savings account only.

my sons drivers license and bank statement showing he is at a different address and his DAte of birth

my apartment lease showing only me and the girls as the only tenants

letter from my bank that i have not made any child support payments to the ex or to my son

just the two pages showing where i do not pay child support and that my ex pays 100% of clothing, school supplies, activity fees and first two years of college education

the page from the instructions of i 864 detailing that i can use child support and my son can be considered majority in my state

I pray this is enough and will be accepted InshALLAH. They did keep his passport and said he was already place in AP

Hi, hope you had some sleep. Ohhhh yes keeping his passport is great news. Now, it's just waiting for them to receive your evidence and we are keeping our fingers crossed. Once they give the passport back and some of the personal information back he gave them than usually its a denial. But they asked you to show evidence and you are. Do you think the documents we are resubmitting are good ones to make it easy for them to understand the parenting agreement...? Having the attorney outline the issue of my son? as well as stating that here in NC he is considered Majority once 18 and per the instructions i can exclude him from my household? He is also reminding them i can include child support per the instructions...it says on the same instruciton page that if you inclde other income such as child support to include documentation and i did.. and he's also telling them the 401k was from QDRO and not job related so i can use it anytime...

thay did give the origninals back but we also had certified copies sent with each original they kept the copies... is that a bad sign then?

OMG pray for me im missing my husband so much!

Its thier ball game, so give them what they want.

It seems if you are a household of 6 you need 37,488 in income per year

If you are a household of 5 then that number is 32,713

Or... 3 times the difference between what the income actually is and what is required in

liquid assets.

You may want to email the consulate and explain the situation and the list of documents you have gathered as evidence and ask if this is sufficient or if there is something else they will require. It should be enough, but it is always at the consulate's discretion just as it is at their discretion to decide on the financial aspect even if you meet the guidelines for the I864.

Is it possible to get an Affadivit from the father saying that he has custody of the son and that you are not required to pay child support per the divorce agreement?

We are a household of 5 which includes my husband overseas. Not 6. Never have paid child suport for my son, never claimed him, ex pays 100% of everything for him and its in the divorce settlement this way.

All they want is proof he doesnt live with me and i dont support him. My attorney looked at the parenting agreement that is incorporated into the divorce thus being court ordered and summarized it so that it's understandable. I am presenting the documetns pertaining to my son with proof of his current address and in the i 864 it states that the 21 yr old unmarried child can be excluded from the household if he reaches majority age in the city of domicile (which he has according to NC law) and I do not claim him on taxes (which i don't and its court ordered that i can not claim him on taxes)as well as verifying with a bank letter that I have not had any payment made from my account to my son for support and that i only receive child support in a consistent income of evry two weeks.

Yes, we know its up to the CO/embassy as to what they need that's why we are verifying everything with information. I gave them overload info that's why it was difficult for them to understand it. We are simplifying it and condensing it and it should be easier now. We will be submitting the documents within the next day or so.
