K1 = FIANCE/FIANCEE (NOT YET married) . very simple.

I am asking those who are doing fraudulent things to bear in mind that many innocent couples get affected by their actions. The more questionable things you do, the stricter the consul people get, the more elusive the US visa gets. It's just not fair.

This is bad. They need to stop the K-1 now or she is risking a lifetime ban. Even then since the petition has made it to the consulate, the CO's will remember this and getting the CR-1 approved is going to be very difficult.

Yeah really, he always has some kind of drama-filled comment, and rarely anything useful.

It is possible that they filed a K-1, then decided to marry later while waiting in the process and didn't ask questions or research on what they needed to do, and now that they're at the interview stage they're thinking about it and freaking out about it. There is no way to know until the OP comes back. But it's not necessarily "fraud"....

I just thought she should cancel the appointment.It really has bn a long process ..but then she can save a life ban for a known duration or resetting things to norm.

This is total Misinformation as people do not essentially make research before filing forms.I do hope her mind isnt set up for the appointment and want to risk giving it a shot

It isn't fraud unless they go through with the process. No one knows the intentions when they first filed. The proper response now would be to cancel the petition and let the consulate know they got married and have abandoned the K1 and will be filing a CR1.

It would be of interest whether they got married AFTER filing the K1 or before filing the K1. This may be where the problem of proceeding may arise. However, speculation without further information isn't prudent. Keep in mind that the OP isn't the actual petitioner or beneficiary. There is information missing for sure.

I read the same problem over and over again and that comes from Morocco! It's like its the same person asking but using a lots of names.

June 13, 2011 - Application send to USCIS thru Fedex

June 17, 2011 - I-129F Packet received by USCIS Signed for by: JCATES

June 22, 2011 - NOA1 (via email)

Oct. 12, 2011 - NOA2 (on USCIS website)

Nov. 28, 2011 - VISA APPROVED . Thank you Lord!!!

It might just be a problem of bad English with nervousness. Every case is different, and unless all details are posted, not easy to make a determination.

If anything, the government here is not precisely clear and transparent in their forms and instructions, that is why VJ exists. Why would every embassy have a different procedure (aside from wanting to protect and catch fraud)??, it would make things much more easy to digest.

Then there is the well known time disparities across Vermont and California, the RFEs, etc. Even if some things are discretionary by the adjudicator, make it so is more predictable.

And they are not always clear and/or knowledgeable:

Just in the past 2 days, my fiancee was told (by an Embassy employee taking calls for fiancee/immigration visas no less) that the DS230 was a must for a K1. My understanding from the instructions is that is no needed unless you are in an immigrant track, which is confirmed here in VJ by a post.
