If she is married she cant file for K1 she will have to refile for a cr1 i beleive!

The idea of a K1 visa is for fiance, which she is not since she is married

May 28 2010 - RFE notification ( yeah Im online checking alot >.< )

June 5 2010 - RFE hardcopy received

June 18 2010 - RFE returned ( had done it June 7 - but USPS returned grrrr )

She or petitioner needs to stop K1 process as she is not eligible if married.

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

She really is married, right? Not just a "ceremonial" wedding that won't be legally recorded anywhere in a government office? I'm grasping at straws but that's your only hope. If the marriage is legitimate, then SOL.

short story for ya...when my hubby had his interview a woman was there in the same situation...they had filed a k-1 even tho she was married with a small child...the CO asked her why did you file for k-1 when you are married and she said someone had told her that the k-1 was faster (evidently they hadn't meant to lie, they just didn't do RESEARCH for the correct visa and listened to someone's bad advice)...at the end of the interview the woman got a lifetime ban but they did tell her the child could still get the visa...if the lady you know was married when they filed the k-1 then things are NOT looking good in her situation...people should ALWAYS do some research before they file any petition to make sure they are filing the right one and NEVER EVER lie to immigration or you can ruin your chances for life

don't pay money for the medical test or interview, to prevent losing some money. stop the case immediately, apply for marriage visa, now it's pretty fast too, no need to take risk now.

Lying to the immigration is a very bad idea. IF she lies and somehow gets the visa and then years later it comes to light that she was really married they can come and take away any status she has ( even revoke citizenship years later ) Think carefully , agencies are sharing more and more information electronically. It is only a matter of time

[First it does says on the side, that a CR-1 was applied for and there is interview scheduled. So, quit insulting this guy as his sister is part of the applicaition. Your sister will need to follow the instructions in her packet from the embassy.

she needs to take proof of her marriage and photom at least 50 of their meeting and marriage celebration and honeeymoon if they had one. She needs copies ot proof they talke a lot. emails, cards, chats, phone records. best of luck to her.

I think you missunderstood the OP. The OP filed correctly for CR-1, but his sister, who is also married to a US citizen, filed for the K1. She/ her husband should not have done this, as it can be seen as missrepresentation and lead to a lifetime ban as mentioned above. I agree with the other posters that the best thing to do is to stop it now, before the interview, that way she avoids a possible ban. Then re-apply for the CR-1.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

No wonder people having trouble getting K1/CR1 in Morocco. more than 50% of the threads from Morocco that I read here are some sort of fraud or look like it.
