Hi everyone!

I just want to ask your ideas on this. I have been looking at all the documents that I have as preparation for my upcoming interview. I have just noticed that the copy of my husband's ITR doesn't have his signature on it. An accountant prepared his form 1040,it has the accountants information but no signature of the accountant too. Do you think I will have a problem with this document?

YES. It should be a SIGNED copy of the return that he submitted to the IRS. You may want to have him get TAX TRANSCRIPTS from the IRS and then scan and email them to you. He can call the IRS and have them faxed to him in a few minutes.

11/15/10: NSO Marriage and Birth Certificates available for pick-up at NSO

11/17/10: Receipt Date of I-130 petition at Chicago Lockbox

11/19/10: NSO Marriage Cert and Birth Cert (4x each) received by Gina in Philippines

11/19/10: CRBA package couriered to US Embassy in Manila

11/22/10: CRBA package/application including NSO BC & MC received by embassy

11/22/10: NOA1 Date

11/24/10: Electronic notification of receipt received from Chicago Lockbox

11/24/10: Embassy scheduled CRBA appointment for 12/21/2010

11/26/20: Check cashed

11/27/10: NOA1 Hardcopy received via USPS

12/21/10: Interview/Personal appearance at Manila Embassy for CRBA **approved**

01/03/11: CRBA and US Passport for daughter received by Gina via FEDEX

Yes. You can have your husband request a free transcript from the IRS. BTW, were you married prior to December 31, 2010, and are you included in that return? It appears so in your timeline. He needed to file married filing separately, or file a joint tax return.

Yup we were married by May 2010 and Yes he did file for a joint tax return. I wanted to make sure that I do have a point before I'll ask my husband about this document. Thank you all for your ideas. I hope I can get his transcript before my interview date which is on July 7th. Do you think it's possible?

A joint tax return will have both persons' signatures on it.

The person who prepared my Husband's Tax form sent another kind of document stating that his spouse is out of the country. I don't think we have further problem with that 'cause IRS even sent him a check because he had paid too much tax for the year 2010. I guess getting a tax transcript is my last option for this.

Yep. We just ordered a set for the last three years. It took about a week to get.

I talked to my Husband and He said that the Original Tax Returns were signed and sent. The one he sent me was just a duplicate copy that the accountant gave him. Do you think the CO won't ask if I have a copy of my Husband's Tax Return then?

Along with the copy of the original tax return (the one with signature(s)) you will need all the supporting documents (W2, 1099, additional schedules, etc). That is why the transcripts are preferred as no other supporting documentation is needed.

I suggest that your husband put forth a bit more effort and get the proper documents to you so that there is no potential delay caused by a request for evidence issued at the interview.

I hear what you guys are saying...but in my case my tax return was filed electronically by me via TurboTax.

I have sent me fiancee a copy of this file with the page that indictaes it was filed electronically. There was never a signature on the return.

Now i could certainly print a copy, sign it and send to my fiancee, but what does that prove. My signature does not mean it's legitimate, nor does it mean that I ever even filed that particular return.

The requiremment for the I-134 does not even include an ITR unless you're self-employed, it requires bank letter and employment verification.

The embassy on the other hand, does ask for a ITR and other documents to accompany the I-134:

"You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134."

But I still don't understand what a signature proves.

Has anyone had an issue with an unsigned copy of a sponsors ITR????

I'm on CR-1 and Affidavit of Support Packet was sent by my husband to NVC. We didn't get an RFE for it so I'm hoping the AOS Packet sent by my husband is good enough that the CO won't ask for tax transcripts on my interview. My Husband is currently in Iraq now and won't be back in US 'til September,he just got there lastweek on a private contract but with the government so i guess it's going to be hard for him to get a hold of those transcripts. I'll just rely on how the Embassy would check things.

My Husband is currently in Iraq now and won't be back in US 'til September,he just got there lastweek on a private contract but with the government so i guess it's going to be hard for him to get a hold of those transcripts. I'll just rely on how the Embassy would check things. Looks like I won't be able to get those tax transcript but I will surely post again on what will happen on my interview. If this causes a delay then I'll let my husband know by then. But I'm confident enough now that the Affidavit of Support Packet that he sent was good enough, since he was able to explain things further to me. The most important thing is he signed the form I-864.

Hi Mrs CDO,

You could go on the IRS.GOV website and request the tax transcript as several others have suggested on here. Then you could take that as well to the int. I'm actually thinking of doing that as well. I think that proves more than a signature on a form....so i's better to have too much than not enough I guess..
