why people need to file 2 case same time?

Hi there, I read alot of post on this site, which people first file I-129f K1 petition, and as well they file I-130 K3 file, why is that?

isnt the K3 petition u can file only when you are married, and if you married then why need to file K1 petition as well? or u able to file both same time?

*January 30 2006 - packet returned.....arggggggggg we forgot one signature!!

*January 31 2006 - sent I129-F back to the CSC, hope we did not forget anything else

*February 1 2006 - I129-F received at CSC again

*February 3 2006 - NOA1

*April 20 2006 - NOA2!!!!!

The person posted in this forum, but is referring to an I-130 which is a K-3, yet they still have K-1 listed on their forum profile, and their timeline says K-3. I think the person who posted that topic was confused.

Point of clarification cause I cant help myself :P I-130 is a petition for alien spouse which is used to gain immigrant status either from entry to the US on a K-3 (which needs an approved I-129F) or for the CR-1 immigrant visa. In order to file the I-129F for a spouse which leads to the K-3 visa, one needs to have already filed an I-130.

No you are not able to file both for a fiance and a spouse at the same time. Some members just get a little confused like the member from the linked thread Arazia referenced. They have filed for K-3 but in doing so they have also filed for CR-1 as an I-130 is required for both.

Points of further clarification:

- I-130 is a petition for an alien relative, not just a spouse.

- I-130 used to take a longer time to adjudicate than it does today, so when the alien relative was a spouse the core family unit was broken up for a long time. How to reunite the family? Allow the alien spouse to enter the USA as a non-immigrant, using the process in place for an alien fiance(e), while the immigration case was in progress.
