When can I file N400?

Hello All,

This is such a great site. I thank you all who have an effort to better the immigration process, help others.

Ok. Here is my question with my brief story! :)

Came to US in 2008, got my green card (conditional), removed conditions in April 2011. It is valid for ten years. What are my options if I want to be a US citizen? When can I file N400? How long do I have to wait before I can file it? Is that true that I can file N400 3 months prior 3rd year anniversary of being a permanent resident (which would mean 01/2012 in my case?)?

Is that the date of marriage or date the card was issued?

You can file the N-400 at 3 years of residency, (File it 1 year after filing I-751 to remove conditions) IF continuously married to same US Citizen for the 3 years.

OR

You can file the N-400 at 5 years of residency if not married to US Citizen.

residency began when you got your first 2 year green-card.

Also there are other requirements, such as:

  • No periods out of the USA longer than 6 months
  • Need to be resident in your field office district for at least 3 months prior to filing.
  • resident in the USA for 18 months if married to a citizen, or 30 months if not

Proposed to her --- 01-03-2009

Our Traditional Introduction (i couldn't go)- 04-21-09

Visit her in Nigeria & she got pregnant-- 07-06-2009

Sent I129F --- 01-02-2010

VSC received I129f--- 01-05-2010

Web NOA 1- 01-06-2010

Visit her in Nigeria --- 01-12-2010

Had a baby boy --- 03-09-2010

Timeline

You sound like you are applying for N400 based on marriage to a US citizen, you can apply 3 years minus 90 days. 90 days doesn't mean 3 months, it's a little less than 3 months. So look at your resident since date add 3 years and minus 90 days. Basically it's the same exact date you filed for removal of conditions but add a year. If you got your green card on January 2009 that means you can apply on January 2012. It's the date on the card when you got approved for permanent residence. In sha allah you hear good news after you file.
