Hi all. Im in a bit of a dilemma. Ive been accepted to graduate school in the states as a Canadian citizen. The process of getting a student visa is rather different then most countries, I just cross the boarder with my I-20 and proof of ties to Canada with all my ID. My fiance and I have been in the process of getting married and our K-1 interview is looking like it will be in October this year in Montreal. Im just wondering is it going to be just a case of me crossing back into Canada to do my interview, and does my F visa go null-in void once accepted, or am I not actually never issued a F visa based on my Canadian Citizenship.

Anyone have a similar situation, and how did they go about doing it?

In case anyone was wondering I managed to figure out the details on this. As a CDN citizen you are not issued a F-1 visa, and you can still go through with the K-1 visa, interview etc. HOWEVER, If you are going down on a "F-1 Visa", you can get married and apply for an adjustment of status, you send in similar proof of an existing relationship as you do with the I-129F forms. You have to be careful, because if you dont have proof, things can be considered as fraud!!!! ALSO, the costs are exceptionally lower relative to continuing with the K-1 Visa route. They will issue you a green card for 2 years before it is renewed, if you give them proof to expect fraud, ie you started school and then didnt bother to go after the first semester, things could get messy. So keep this in mind if you're considering the F-1 visa route compared to the K-1 Visa route!

Yes its called AOSing from within the USA.

You file the I-130 and the I-485 together and include all documents requested. You get the same green card as you would applying for K-1. Its not that much cheaper because AOS still costs 1070$. Then they have to add the medical onto it as well which is more expensive in the USA.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.
