Filing while spouse is in US

If you get married in the US but your spouse is planning to go back to their country to work, tie up loose ends etc. Is it possible to begin the K-3 process while they are in the states?

does anyone know what the turnaround time is for the k-3 at the moment?

You can check out the Processing Times for the K3 on VJ to get an idea of how long you will be waiting. It's a while.... Look around, read some timelines, check out some timelines for others filing from your same area.

I'll let someone else answer the first question.

Sure. You can file while your spouse is here. Just mention on I-129F form the cousulate where (s)he will apply for K3visa. Infact, for K3 the the applicant must be interviewd at their home country's consulate. So yeah, file for K3, send your spouse back, and let him/her come on K3. But Try to stay with him/her as long as possible in U.S cuz once you two seperate, it will be a very hard time. But don't let the visa expire before (s)he goes back. Yes, it is possible to begin the process while your spouse is here. As long as your spouse entered legally and leaves the country before any overstay occurs, then you should be fine.

yeah, I was in the US when we sent in our stuff, they didn't even ask about it at interview.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

Expecially for Australians: Have you researched Direct Consular Filing/DCF? Can the USC go to Australia?

It takes more than one day in Australia now, but it looks like total case time can be as little as a month, maybe less.
