Hey

My father in law ( wife's father) lives in Texas, and he is green card holder, he is the petitioner for his son, and he is not working ( unemployed ).

my wife and I live in Michigan, and both hold usa citizenship, I work and have enough income, my wife doesn't work, we have two kids.

My father in law asks to be co-sponsor.

my understandingas the following:

1- Father in law should fill I-864

2- I should fill I-864

3- My wife should fill I-864A

are the above correct?

With the information provided YOUR wife will not complete the I-864A.... at all.

You sir will complete the I-864 which will cover you/wife.

because two diff. residence are noted the I-864 A is out

my mother (unemployed/lpr) filed 1864 for us..my brother (USC /employed) filed 2864-a for us...I hope this helps

The I-864A isn't an affidavit of support on it's own. It's a contract between a household member and a sponsor where the household member agrees to make their income available to help the sponsor qualify. Ricardo is correct that the OP's wife isn't a qualified household member of the OP's father, so she couldn't submit an I-864A to be joined with the father's I-864. However, she is a qualified household member of the OP (I'm presuming they live together in Michigan), so she could submit an I-864A to be joined with the OP's I-864. Joint sponsors can also use I-864A's from household members.

In the OP's case, it wouldn't any difference if his wife submitted an I-864A. She doesn't have any income to contribute.

Hello

I have a similar problem

I am a LPR and applied for my unmarried daughter -F2B

As I am not working what forms do I fill for the AOS - I spend some time with my son (who has just graduated and started working ) and some time with my brother who was our original sponsorer. I did not stay with my son as he was studing.

Now that my son is working I can ask him to fill the AOS - can I say that now I stay with him and so he is a household member and so he is filling the AOS and so the I-864A?

The I-864A isn't an affidavit of support on it's own. There are two additional forms of evidence you must provide with an I-864A that you don't have to provide with an I-864 - you must provide evidence that the household member is a qualifying relative, and you must provide evidence that you live in the same household. Unless you have this evidence, your son should submit an I-864 as a joint sponsor. The only advantage to using an I-864A is that it allows a sponsor and a qualifying household member to join their income and become a single entity. The only time this is useful is when NEITHER the sponsor nor the household member are qualified on their own to submit a sufficient affidavit of support. Since you have no income there is virtually no advantage to using an I-864A in your case.

That was very useful info. So This means that 1. I submit I-864 with zero income 2. My son submits I-864 as a joint sponsorer. This will not be a problem as he has a good income to show and he is single. This also means that I dont have to be living with my son. I can show my address as that of my brother.
