Please help kung may idea kayu kung bakit nangyari to.

Here are the details of my sister.

my mom is LPR.

Date of Birth: May 20, 1991

Prioriy date: June 17, 2011-F2A

Approval date: February 21, 2012

worried na talaga kami if di kasama ate ko.

On august 2012. naka recv kami nang DS3032. but SISTER KO WALA D:

nag sorry kasi ung NVC dahil na delay ung proces at hindi nila na sent ng sakto. may kinalaman po ba to sa CSPA? di ba po di n mn cla mag cocompute ng CSPA pag di pa na curret ung PD?

email/call kami sa NVC peru last mesge s NVC ay (Nov. 12, 2012) ito yung nakasulat sa reply nila

"We updated the mailing/email address for this case. Please continue to notify the NVC of any change of mailing/email address, or change in personal situation that may affect the principal applicant's entitlement to a visa.

This case is currently under review for applicability of the Child Status Protection Act (CSPA). You will be notified once a decision is reached. I got here as single Oct 2010 and received my Green Card pero may Girlfriend ako and 2 kids dyan sa Pinas. Bumalik ako sa Pinas para pakasalanan sya then bumalik ako ng US

Then nag file ako ng petition F2A and their priority date is OCT 2011. My question is kailangan ko pa bang mag file ng separate petition or form I-130 para sa 2 kids ko? Kasi ang file ko lang is isang I-130 for my wife pero naka indicate naman dun yung details ng dalawang anak namin. Do I need to file a completely separate I-130 form for my two kids and also pay a separate filing fee? If you need more info just let me know. Thanks in advance. God bless on your JOURNEY!

Seems USCIS decided to change that one,

during our petition process last 2009, hindi na kami nag-file ng separate I130 for our 2 kids,

dahil during that time, nasa instruction ng I130 na pag Permanent Resident ang nagfile ng petition,

derivative status na agad ang children (under 18), pero kung US Citizen ang magfile ng petition,

ubligadong magfile ng hiwalay na I130, that was the only advantage ng PR dati, I tried to look into the

revised I130 instruction ngayon, mukhang ubligadong hiwalay na ang filing ng I130 ng mga minor,...

Will try to search still kung pwede pa rin yan sa derivative status,...

I just read the I130 instructions again,

the revised one:

Look at the note on Paragraph 2. number 3....

If your children qualifies, seems derivative pa rin sila, and therefore hindi mo kailangan ng separate I130 filing for them,...

No need to file i-130 for your kids. They will become derivatives of your wife on her F2A petition. When your wife receives the Choice of Agent and Address form (DS-3032), tell her to include a letter stating that she wants your children to be her derivatives, attach the children's original NSO birth certificates on the letter.

HI Apple21 and Cardilene THANKS for your prompt reply I really appreciate it. FYI this is my wife's account :-). I'm still confused my lawyer as well said no need to file for my 2 kids but in the I-130 instruction here what it says:

2. If you are a lawful Permanent resident of US you may file this form for:

A. Husband or wife

B. Unmarried child under 21

C. Unmarried son or daughter age 21 or older

Note:

If your relative qualifies under paragraph 2(B) or 2( C ) above separate petition are not required for his or her unmarried children under 21 of age.

So I filed a petition for my LOVING wife and my preference classification is 203 A2A INA SPOUSE OF LPR (I assumed this is F2A) which is 2(A). I wanted to clarify on the "NOTE" in the instruction if you analyze it thoroughly. My lawyer as well says no need to file separate for my 2 kids But there's this side of me that don't agree. SHOULD I file a separate petition for my 2 kids or no need? Thanks a lot in advance! ( JUST A DESPERATE FATHER and longing for my family )

1995: Met my Girl friend

1996-2000: 2 bouncing baby boys arrived

1999: My mom filed a petition F2B unmarried son 21 older for me

June 2010: Received F2B approval

Oct 2010: Left my LOVING wife and 2 kids in the Philippines ( still not married )

Oct 9 2010: arrived USA alone

May 25 2011: Went back to Philippines got MARRIED (finally)

Oct 9 2011: Filed a petition for my wife 203 A2A INA SPOUSE OF LPR ( didn't file a separate petition for my 2 kids cause my lawyer said so)

Oct 13 2011: Received NOA1 for my wife's petition

waiting for NOA2.........

Like ng mga cnabi ng mga kababayan natin, no need to file and send form separately. Hanggat LPR ka, ok lang na magkakasama sila sa petition. Pero pag USC, dpat hiwa-hiwalay. Yan din naging worry ko sa case namin. But when i called the NVC, they told me na included ang baby namin sa petition. Once you received instructions from NVC, like Payment of IVFee, magbabayad ka para sa kanila lahat, sa asawa mo at kung ilan ang anak mo na kasama sa petition. If 3 sila, x3 ang IVF na babayaran mo. You will also need to submit individual civil documents.
